Resolution to Waive Attorney Client Privilege as to Attorney Salvatore Investigative Report and to Make the Report Public

Body

Whereas, An investigation was conducted by an outside investigator concerning a written complaint by HR Director Guajardo against Assistant City Administrator John Fournier (then acting as Acting City Administrator);

 

Whereas, On October 4, 2021 this investigation was authorized by Resolution R-21-380 by the City Council; 

 

Whereas, Attorney Jennifer Salvatore conducted the investigation and issued a report dated November 23, 2021, which has been delivered to the City Council; and

 

Whereas, The City Council, for the sake of transparency, believes that this report should be made public, with appropriate privacy or other redactions as determined by the City Attorney;

 

RESOLVED, That the Investigative Report dated November 23, 2021, be made public as soon as possible by the City Attorney, with appropriate privacy or other redactions, if any;

 

RESOLVED, That the complaint documents dated October 1, 2021 and October 4, 2021 be made public by the City Attorney at the same time as the Investigative Report, with appropriate privacy or other redactions, if any; and

 

RESOLVED, That the Council directs the City Attorney’s Office to provide details, circumstances, and advice regarding the “Additional Observations” section of the Investigative Report to the Council for its review.
