Your approval is requested for Amendment No. 1 to the Professional Services Agreement with Orchard, Hiltz & McCliment, Inc. d/b/a OHM Advisors (OHM) in the amount of $208,000.00 for construction engineering services related to the WWTP Clear Well Improvements Project.
The City’s WWTP utilizes 12 sand filters for tertiary treatment to remove fine solids from the water. Filtered water is collected in two clear wells located under the Tertiary Filter Building where the water is aerated before it flows to the ultraviolet disinfection system prior to discharge to the Huron River.
This project is to replace structures and equipment that have reached the end of their useful life and are in need of replacement. Concrete block baffle walls located in the two clear wells have deteriorated and are failing, while the air diffusers are damaged and must be replaced. These structures and equipment are essential to assure the intended operation of the clear wells and provide dissolved oxygen to ensure the WWTP complies with its discharge permit limits.
Through RFP No. 19-13, the WWTP solicited proposals for professional engineering services to design the WWTP Clear Well Improvements Project. On December 16, 2019, City Council approved Resolution R-19-563 in the amount of $133,036.00 for professional engineering services with OHM for the Clear Well Improvement Project. As part of this work, OHM completed inspection and evaluation of the clear wells and air diffusers, prepared an Alternatives Evaluation Report of feasible alternatives, prepared a Preliminary Design Report and contract documents for soliciting contractor bids.
As stated in RFP 19-13, City staff requested a proposal from OHM for construction engineering services related to the WWTP Clear Well Improvements Project. WWTP staff reviewed the proposed scope of services, schedule and fee submitted by OHM and determined they are reasonable.
WWTP staff is requesting your approval of Amendment No. 1 to the contract with OHM in the amount of $208,000.00 and a contingency in the amount of $30,000.00 to fund additional necessary services as approved by the City Administrator.
OHM complies with the requirements of the City’s Conflict of Interest, Non-Discrimination, and Living Wage ordinances.
Budget/Fiscal Impact: Funds to finance the work to be performed under this contract amendment are included in the approved Sewage Disposal Fund Capital Budget.

Whereas, On March 4, 2019, Council approved a Professional Services Agreement with OHM in the amount of $133,036.00 to design the WWTP Clear Well Improvements Project;
Whereas, As stated in RFP 19-13, OHM submitted a proposal in the amount of $208,000.00 to provide construction engineering services related to the WWTP Clear Well Improvements Project, which WWTP staff determined to be reasonable;
Whereas, WWTP staff requests a contingency in the amount of $30,000.00 to fund additional necessary services as approved by the City Administrator;
Whereas, OHM complies with the requirements of the City’s Conflict of Interest, Non-Discrimination, and Living Wage ordinances; and
Whereas, Sufficient funds for the work to be performed under this contract amendment are included in the approved Sewage Disposal Fund Capital Budget;
RESOLVED, That City Council approve Amendment No. 1 to the Professional Services Agreement with Orchard, Hiltz & McCliment, Inc. d/b/a OHM Advisors in the amount of $208,000.00 for construction engineering services related to the Tertiary Clear Well Improvement Project;
RESOLVED, That Council approve a contingency of $30,000.00 to fund additional necessary services as approved by the City Administrator in order to satisfactorily complete the project;
RESOLVED, That the City makes the following declaration for the purposes of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expect to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and
Resolved, That the City Administrator be authorized to take all necessary actions to implement this resolution.
