Resolution to Approve a Construction Contract with Commercial Contracting Corporation for the WWTP Clear Well Improvements Project ($1,335,000.00, ITB 4680)

Memorandum

Your approval is requested for a construction contract with Commercial Contracting Corporation (CCC) in the amount of $1,335,000.00 to construct the Wastewater Treatment Plant (WWTP) Clear Well Improvements Project.

 

The City’s WWTP utilizes 12 sand filters for tertiary treatment to remove fine solids from the water.  Filtered water is collected in two clear wells (north and south) where the water is aerated before it flows from the wells by gravity to the ultraviolet disinfection system prior to discharge to the Huron River. The clear wells are located under the Tertiary Filter Building and each is only accessible through several 4-foot by 4-foot openings, which means the clear wells are confined spaces with limited access and egress.

 

Concrete block baffle walls and air diffusers located in the two clear wells need replacement due their deteriorating and failing condition. These structures and equipment are essential to assure the intended operation of the clear wells and provide dissolved oxygen to ensure the WWTP complies with its discharge permit limits.

 

In response to ITB No. 4680, one bid to construct the WWTP Clear Well Improvements Project was received and publicly opened on June 1, 2021. The bid submitted was as follows:

                     Commercial Contracting Corporation, Inc.                     $1,335,000.00

 

WWTP staff reviewed the bid, compared it to ITB No. 4680 specifications and recommends that CCC be approved as the lowest responsible bidder to construct the WWTP Clear Well Improvements Project.

 

WWTP staff is requesting your approval of a contract with CCC in the amount of $1,335,000.00 and to approve a contingency in the amount of $133,000.00 to fund additional necessary services as approved by the City Administrator.

 

CCC complies with the City’s Conflict of Interest, Non-Discrimination, Living Wage, and Prevailing Wage ordinances.

 

Budget/Fiscal Impact: Funds to finance this contract are included in the approved Sewage Disposal System Capital Budget.

Whereas, An evaluation of the clear wells determined that concrete block baffle walls and air diffusers are deteriorating and failing and must be replaced;

 

Whereas, These structures and equipment are essential to assure the intended operation of the clear wells and provide dissolved oxygen to ensure the WWTP complies with its discharge permit limits;

 

Whereas, One competitive bid was received in response to ITB No. 4680 to construct the WWTP Clear Well Improvements Project on June 1, 2021, and based on review of this bid WWTP staff recommends Commercial Contracting Corporation, Inc. (CCC) as the lowest responsible bidder for this work;

 

Whereas, Sufficient funds for this contract are included in the approved Sewage Disposal System Capital Budget; and

 

Whereas, CCC complies with the requirements of the City’s Conflict of Interest, Non-Discrimination, Living Wage, and Prevailing Wage ordinances;

 

Resolved, That City Council approve a construction contract with Commercial Contracting Corporation in the amount of $1,335,000.00 for the WWTP Clear Well Improvements Project (ITB 4680);

 

RESOLVED, That a contract contingency in the amount of $133,000.00 be established within the project budget and that the City Administrator be authorized to approved change orders to the construction contract with Commercial Contracting Corporation not to exceed $133,000.00 to address any unforeseen issues and to satisfactorily complete the project;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to substance by the City Administrator and approval as to form by the City Attorney;

 

RESOLVED, That the City makes the following declaration for the purposes of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal revenue Code of 1986, as amended, that the City reasonably expect to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and

 

RESOLVED, That the City Administrator be authorized to take the necessary actions to implement this resolution.
