Resolution to Accept North Access Easement at Mallett’s Wood Condominium from Mallett’s Wood Homeowners Association (8 Votes Required)

Memorandum

This easement is a PUD easement from the Mallett’s Wood Site Condominium Revised Final Phase PUD which was approved by Council on February 5, 1996, in R-51-2-96. This easement is in standard form and is conveyed without cost to the City.

 

Acceptance of this easement is recommended.

Whereas, The Mallett’s Wood Homeowners Association, a Michigan nonprofit corporation, is the association of co-owners designated to administer real property located in the City of Ann Arbor, Washtenaw County, Michigan, commonly known as Mallett’s Wood condominium described in the Consolidated Master Deed recorded in Liber 4380, Page 144 of Deeds, Washtenaw County Records; and

 

Whereas, The Mallett’s Wood Homeowners Association has signed a grant of easement for public access as shown and described on the attached map:

 

COMMENCING AT THE CENTER OF SECTION 10, T3S, R6E, CITY OF ANN ARBOR, WASHTENAW COUNTY, MICHIGAN, THENCE S89°57'00"E 655.90 FEET ALONG THE EAST AND WEST 1/4 LINE OF SAID SECTION, THENCE N01°44'00"E 1011.01 FEET ALONGTHE WEST LINE OF BARFORD HOMES SUBDIVISION AS RECORDED IN LIBER 15 OF PLATS, PAGES 13 AND 14, WASHTENAW COUNTY RECORDS (AND THE NORTHERLY EXTENSION THEREOF); THENCE S88°13'50"E 175.10 FEET; THENCE N01°44'00"E 657.94FEET; THENCE S88°16'00"E 103.68 FEET TO THE POINT OF BEGINNING; THENCE N01°44'00"E 435.05 FEET; THENCE S68°29'10"W112.86 FEET; THENCE N1°44'00"E 32.65 FEET ALONG THE WEST LINE OF MALLET'S WOOD CONDOMINIUM PLAN NO. 248; THENCEN68°29'10"E 168.89 FEET; THENCE S01°44'00"W 279.82 FEET ALONG THE WEST LINE OF SPRINGWATER SUBDIVISION NO. 2 ASRECORDED IN LIBER 4 PAGE 47 OF PLATS, WASHTENAW COUNTY RECORDS; THENCE N88°16'00"W 43.50 FEET; THENCES01°44'00"W 210.00 FEET TO THE SOUTH LINE OF UNIT 31 OF SAID MALLET'S WOOD CONDOMINIUM; THENCE ALONG SAID SOUTHLINE N88°16'00"W 8.00 FEET TO THE POINT OF BEGINNING. RESOLVED, That the City of Ann Arbor hereby accepts this grant of easement.
