Resolution to Approve a Maintenance and Cost Participation Agreement with the Washtenaw County Road Commission for the South State Street and West Ellsworth Road Intersection

Memorandum

Attached for your review and approval is a resolution to authorize an agreement with the Washtenaw County Road Commission (WCRC) for the maintenance and cost sharing for the South State Street and West Ellsworth Road intersection.

 

It has long been understood between the two agencies that the City of Ann Arbor has jurisdiction over the northern and eastern legs of this intersection, while WCRC has jurisdiction of the southern and western legs. However, there has never been a formal agreement between the two agencies regarding responsibility for the intersection itself. In 2013, the City and WCRC conducted a joint project to construct the roundabout that now exists and the intersection. The construction of this project added additional physical elements at the intersection (splitter islands, crosswalks, center island) for which there was no clearly defined maintenance responsibility.

 

The attached agreement spells out the responsible agency for each maintenance activity, which includes pavement, traffic control devices, mowing, pedestrian signals, and streetlights. The agreement also indicates the portion of the cost that each agency will bear for the necessary maintenance work.

 

Budget/Fiscal Impact:  The cost of the maintenance activities outlined in this agreement is included within existing operating and maintenance budgets.  Funding is anticipated to be available in future fiscal years, if so, approved by City Council.

Whereas, The existing roundabout at the intersection of South State Street and West Ellsworth Road was constructed in 2013;

 

Whereas, No formal agreement between the City of Ann Arbor and the Washtenaw County Road Commission currently exists regarding maintenance responsibilities for the intersection;

 

Whereas, The proposed agreement will specify both agency’s maintenance and fiscal responsibilities for the intersection, the terms of which are agreeable to the City; and

 

Whereas, The cost of the maintenance activities outlined in this agreement is included within existing operating and maintenance budgets and is anticipated to be included in future fiscal years, if so approve by City Council.

 

RESOLVED, That City Council approve the attached Agreement with the Washtenaw County Road Commission for the maintenance and cost sharing for the South State Street and West Ellsworth Road Intersection;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to form by the City Attorney and approval as to substance by the City Administrator; and

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
