Whereas, Former Chief Assistant City Attorney Abigail Elias was willing to come back and assist the City previously to assist in the training of the Senior Assistant City Attorney hired in 2019 and was previously hired on a temporary basis in 2019;
Whereas, Additional professional legal services was needed for FY 2021 after the training was completed on a temporary basis for specific legal projects, primarily including a phosphorus discharge case, and the Gelman matter in FY 2021;
Whereas, A contract for temporary employment to provide these discrete services was entered into July 10, 2020 for $25,000;
Whereas, Attorney Elias services were needed for continuity of services and are projected to be needed through April 15, 2021;
Whereas, A $15,000 amendment was approved on March 15, 2021;
Whereas, This amendment was to cover approximately 225 hours from December through April;
Whereas, Additional work was needed on the Gelman matter and filings in the state court have been completed for the hearing which was set for May 3;
Whereas, Attorney Elias’s work will be completed by May 14, 2021; and
Whereas, This amendment will cover approximately 75 hours in April and May.
RESOLVED, That the attached Amendment Number Two to the agreement with Abigail Elias be approved; and
RESOLVED, That the City Administrator, Mayor and City Clerk be authorized to sign the amendment to the contract.
