Resolution to Award a Construction Contract to Doan Construction Co. (Bid No. 4677) for the 2021 Annual Sidewalk and Ramp Repair Project ($581,563.15)

Memorandum

Attached for your review and approval is a resolution to award a contract to Doan Construction Co. in the amount of $581,563.15 for the 2021 Annual Sidewalk Repair Program (Bid No. 4677).

 

The project will consist of replacing select sidewalk slabs in approximately 20% of the City in 2021, as part of the fifth year of a 5-year program to perform repair and maintenance on the City’s sidewalk system. The project also includes the replacement of sidewalk curb ramps to meet the requirements of the Americans with Disabilities Act (ADA) that are requested throughout the City. The attached map depicts the areas up for maintenance or repair in 2021.

 

The 2021 Annual Sidewalk Repair Project is created as a unit price contract with the understanding that the actual quantities used in construction will vary.

 

Project specifications were distributed electronically to contractors, subcontractors, and suppliers. 1 bid was received and opened on April 27, 2021. The sole bidder was Doan Construction Co. with a bid of $581,563.15, which is approximately $81,717.15 higher (16.35%) than the Engineer's Estimate of $499,846.00.

 

Doan Construction Co.  has successfully completed the repair work in the City of Ann Arbor for the past seven years and is able to meet the project requirements. The 2021 contract is structured to allow for two additional one-year renewals, if agreeable to both parties. The Contractor is required to hold their bid prices for this, and any subsequent, contract renewals.

 

Doan Construction Co. has submitted all required Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Non-Discrimination, Prevailing Wage and Living Wage ordinances.

 

Budget/Fiscal ImpactFunding for the project is included in the appropriate approved capital budgets and comes primarily from the Street, Bridge, and Sidewalk Millage; with some additional funding from the Major and Local Street Funds, Ann Arbor Area Transportation Authority, Downtown Development Authority, and various departmental budgets within the City of Ann Arbor, depending on the locations at which the work is done.  No additional maintenance costs are anticipated with the planned sidewalk replacements.

Whereas, The Annual Sidewalk Repair Program is necessary to maintain or repair pedestrian facilities in the City of Ann Arbor;

 

Whereas, The 2021 Annual Sidewalk Repair Project includes the repair of deficient sidewalks in approximately 20% of the City and the replacement of sidewalk curb ramps on a request basis to meet the requirements of the Americans with Disabilities Act (ADA);

 

Whereas, Competitive bids were received by Procurement on April 27, 2021 and Doan Construction Co. was the sole responsible bidder;

 

Whereas, Staff evaluated the submitted proposal and found Doan Construction Co.’s bid to be reasonable, but slightly higher than current market prices;

 

Whereas, The Contract sets forth the services to be performed, and the payments to be made by the City therefore, all of which are agreeable to the City;

 

Whereas, The 2021 contract is structured to allow for two (2) additional one-year renewals, if agreeable to both parties, subject to the terms and conditions in the original contract;

 

Whereas, The Contractor has submitted all required Non-Discrimination, Responsible Bidder, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms; and

 

Whereas, Funding for the project is included in the appropriate approved capital budgets and comes primarily from the Street, Bridge, and Sidewalk Millage; with some additional funding from the Major and Local Street Funds, Ann Arbor Area Transportation Authority, Downtown Development Authority, and various departmental budgets within the City of Ann Arbor, depending on the locations at which the work is done;

 

RESOLVED, A contract in the amount of $581,563.15, be awarded to Doan Construction Co. for the 2021 Annual Sidewalk and Ramp Repair Program;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said Contract after approval as to form by the City Attorney and approval as to substance by the Public Services Area Administrator and City Administrator;

 

RESOLVED, That a contingency amount of $60,000.00 be established within the Project budget, and that the City Administrator be authorized to approve change orders to the Contract with Doan Construction Co., not to exceed that amount, in order to satisfactorily complete this project;

 

RESOLVED, That the City Administrator be authorized to approve the extension of the contract for two additional one-year renewals in years 2022 and 2023, subject to the availability of funding; and

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution including approval of needed Traffic Control Orders, night work authorizations, and other similar administrative approvals to allow the work of the project to proceed without delay.
