Resolution to Authorize Amendment No. 1 to the Professional Services Agreement with West Erie Realty Solutions Ltd. for Easement and Right of Way Acquisition Services

Attached for your approval is a resolution authorizing Amendment No. 1 to the Professional Services Agreement with West Erie Realty Solutions Ltd. (West Erie)
A contract with West Erie for Easement and Right-of-Way Acquisition Services was authorized by city council (R-18-267) on July 2, 2018 in the amount of $175,000.00.
The contract has been renewed twice per the terms of the agreement and is set to expire on June 30, 2021.
West Erie is currently providing easement acquisition services to the City on the LynAnne-Arbana Sanitary Sewer Project. These services will be required past the current June 30, 2021 contract expiration date. Amendment No.1 will extend the contract under the current terms and cost authorization until June 30, 2023 in order to complete easement acquisition for the project.
West Erie is in compliance with the requirements of the City’s Non-Discrimination and Living Wage ordinances.
Budget/Fiscal Impact: Funding for the services provided by these consultants are available within the approved project budget.

Whereas, The City and West Erie Realty Solutions Ltd. (West Erie) have entered into a Professional Services Agreement for Right of Way and Easement Acquisition Services (Agreement);
Whereas, The Agreement is set to expire on June 30, 2021;
Whereas, West Erie is currently providing Easement Acquisition Services to the City on the LynAnne-Arbana Sanitary Sewer Project;
Whereas, Easement Acquisition Services for the LynAnne-Arbana Project will be required past June 30, 2021;
Whereas, Amendment No. 1 extends the Agreement to June 30, 2023, with the same terms and conditions as the original Agreement and includes an option to extend for one 1-year period;
Whereas, Amendment No. 1 makes no change to the $175,000.00 authorization previously approved for the Agreement;
Whereas, West Erie is in compliance with the City’s Non-Discrimination and Living Wage ordinances; and
Whereas, The required funds for these services are available in approved project budget;
RESOLVED, That the City Council approves Amendment No. 1 to the Professional Services Agreement with West Erie Realty Solutions Ltd., for easement and right-of-way acquisition services;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said Amendment No. 1 after approval as to form by the City Attorney and approval as to substance by the City Administrator; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
