Resolution to Approve a Contract with All Star Power Excavation L.L.C. to Renovate the Pathway Near the Boat Launch at Gallup Park ($245,209.00)(ITB 4638)

Memorandum

Attached for review and action is a resolution to approve a $245,209.00 contract with All Star Power Excavation L.L.C. to renovate pathways at Gallup Park.

 

Budget/Fiscal Impact:  Funding is available in the approved FY2021 Park Maintenance and Capital Improvement Millage budget.

 

Project Description:  The boat launch path, running along the north bank of the Huron River from the boat launch to the Gallup Livery, is in need of repairs. The Parks and Recreation Open Space Plan (PROS) prioritizes the repair and replacement of pathways to maintain safety and usability. Additionally, this pathway does not currently meet AASHTO standards and the PROS plan recommends updating to these standards when renovating existing pathways. New ADA picnic tables and benches will be installed along the path to provide for a better user experience.

 

Path repairs and reconstruction are identified in the CIP and PROS plan as park priorities.  Additionally, the project meets multiple Sustainability Goals, including:

                     Safe Community

                     Active Living and Learning

                     Transportation Options

 

The contract documents for the project were bid through the City’s Procurement Unit following standard procedures. Two options were bid to allow for purchasing flexibility:

                     Option A would crush the existing path and use that material as a new base to pave over.

                     Option B would excavate the existing path and add a new limestone aggregate base to pave over. 

                     While both Option A and B will provide the park with a new surface that will withstand the heavy daily use, Option A is preferred for this stretch of path in Gallup Park due to the following reasons:

o                     Requires less construction equipment and traffic to an area of the park with space constraints and construction access challenges.

o                     Reduces the amount of construction waste needing to be removed from the park.

o                     Lower construction cost

 

Due to proactive measures of controlling stormwater, both Option A and Option B provide for a lifespan of 20+ years. Option B may extend the life an additional 5 years.

 

Six bids were received an opened August 5, 2020. The lowest responsible bid is from All Star Power Excavation, L.L.C. in the amount of $245,209.00 for Option A (crush & shape) and $365,743.00 for Option B (new path base). Below is a tabulation of the bids received for the project.

Staff is recommending awarding a contract to All Star Power Excavation L.L.C. in the amount of $245,209.00 for Option A improvements to the segment of path near the boat launch at Gallup Park. A 10% construction contingency ($24,520.90) is requested to cover potential contract change orders to be approved by the City Administrator. It is requested that a $269,729.90 contract and contingency amount be approved for the life of the project without regard to fiscal year.

 

The Parks Advisory Commission recommended approval of this contract at their September 15, 2020 meeting.

Whereas, The boat launch pathway in Gallup Park is in need of major renovation,

 

Whereas, The Parks and Recreation Open Space Plan (PROS) recommends infrastructure improvements for pathways that are in disrepair;

 

Whereas, Funding for the Gallup Park Pathway Renovations is available in the approved FY2021 Park Maintenance and Capital Improvements Millage budget;

 

Whereas, In response to ITB 4638 competitive bids were received by Purchasing on August 5, 2020;

 

Whereas, All Star Power Excavation L.L.C. submitted the lowest responsive bid;

 

Whereas, The Parks Advisory Commission recommended approval of this contract at their September 15, 2020 meeting; and

 

Whereas, All Star Power Excavation L.L.C. has submitted all required Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Non-Discrimination, Prevailing Wage, and Living Wage Ordinances;

 

RESOLVED, That the City Council approves a contract with All Star Power Excavation L.L.C. to renovate the boat launch pathway in Gallup Park (ITB 4638) in the amount of $245,209.00 and approve a construction contingency of $24,520.90 (10%) to cover potential contract change orders for a total contract amount of $269,729.90 for the life of the project without regard to fiscal year;

 

RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney; and

 

RESOLVED, That the City Administrator is authorized to take all necessary administrative actions to implement this resolution including the authority to approve change orders within the approved contingency.
