Resolution to Approve an Amendment to an Agreement with DTE Gas Company at 841 Broadway for the Allen Creek Railroad Berm Opening Project (8 Votes Required)

Memorandum

On March 18, 2019, R-19-115, City Council approved an Agreement with DTE Gas Company for Storm Water and Sidewalk Easements and a Temporary Construction Permit (“Agreement”) for the Allen Creek Railroad Berm Project. The Agreement was recorded April 1, 2019 in Liber 5297, page 725 and April 15, 2019 in Liber 5299, page 354, Washtenaw County Records.

 

The project has required more temporary construction area than originally anticipated, therefore the parties would like to amend the Temporary Construction Permit portion of the Agreement to allow the City and its contractors additional temporary construction area consistent with the attached drawing.

Body

Whereas, DTE Gas Company is the owner of 841 Broadway, Ann Arbor, Michigan 48105; and

Whereas, Both the City of Ann Arbor and DTE Gas Company wish to amend the Agreement recorded in Liber 5297, page 725 and Liber 5299, page 354, to include additional area in the Temporary Construction Permit portion of the agreement.

RESOLVED, That the City of Ann Arbor hereby approves the amendment to the Agreement with DTE Gas Company to allow additional temporary construction area;

RESOLVED, That the Mayor and City Clerk are authorized and directed to sign the Amendment on behalf of the City after approval as to form by the City Attorney and approval as to content by the City Administrator; and

RESOLVED, That the City Administrator is authorized to take all appropriate action to implement this resolution.
