Memorandum

Attached for your consideration and approval is a resolution to approve change orders number 4 and 5 with Action Traffic Maintenance, Inc. for a total amount of $37,407.39 for the maintenance and replacement of guardrails at various locations throughout the City.  

 

The City has guardrails in approximately 60 locations, and until now has addressed their condition reactively (e.g., after a guardrail had been damaged).  In order to address the proactive updating and repair of guardrail throughout the City, Council awarded a construction contract to Action Traffic Maintenance, Inc. on September 17, 2018 in the amount of $322,527.00 plus a contingency of $32,000.00, for a total authorized amount of $354,527.00.

 

While change orders #1- #3 were within the authorized amount and were approved administratively, change order #4 ($89,297.38) was erroneously approved in April of 2020, which exceeded the Council authorized amount. Change order #5 corrects this error and sets the total contract amount at $391,934.39, which is expected to be sufficient to complete the remaining work. It should be noted that to date, $321,589.39 has been paid to the contractor, which is still within original amount authorized by City Council.

 

The remaining guardrail repair work under this program is expected to be completed this Fall. Upon completion of this work, the City will have completed all its planned capital maintenance on the guardrail system.

 

Action Traffic Maintenance, Inc. is in compliance with the requirements of the City’s Non- Discrimination and Living Wage ordinances.

 

Budget/Fiscal Impact:  Funding for this work was is available in FY 21 Approved Major Street Fund Operations and Maintenance Budget.

Whereas, The City issued ITB No. 4546 for this work and received bids on August 21, 2018;

 

Whereas, Council awarded a construction contract to Action Traffic Maintenance, Inc. on September 17, 2018 in the amount of $322,527.00 plus a contingency of $32,000.00, for a total authorized amount of $354,527.00;

 

Whereas, Change Orders No. 4 and 5 will adjust the total contract amount to $391,934.39, which will be sufficient to complete all of the planned preventative maintenance work on the guardrail system;

 

Whereas, Funding for this work is available in the FY 21 Approved Major Street Fund Operations and Maintenance Budget; and

 

Whereas, Action Traffic Maintenance, Inc. is in compliance with the requirements of the City’s Non-Discrimination and Living Wage ordinances;

 

RESOLVED, That Change Orders Number 4 and 5 to the construction contract with Action Traffic Maintenance, Inc. for 2018 Guardrail Rehabilitation Program be approved in the total amount of $37,407.39 for additional amounts of work under the contract; and

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
