Resolution to Approve Amendment Number 4, to the Professional Services Agreement with Tetra Tech, Inc. for the Ann Arbor Landfill Monitoring and Maintenance Program and Appropriate ($124,907.73) (8 Votes Required)

Memorandum

Attached for your review and approval is a resolution for Amendment No. 4 to the Professional Services Agreement with Tetra Tech, Inc. (R-17-255 & R-19-319) for environmental consulting services for the Ann Arbor Landfill Monitoring and Maintenance Program, through June 30, 2021. This resolution will increase the professional service agreement by $124,907.73 bringing the total contract value to $476,031.73 with an additional $40,000.00 contingency amount.

 

Amendment 4 is needed to perform necessary repairs and maintenance to one of the wells used in the landfill monitoring program and to repair a small portion of the landfill cap that has thinned over time.  These repairs exceed the scope of routine maintenance anticipated when the original contract and budget were set, but are necessary to remain in compliance with state regulations. The well work includes installation of valving, replacing a section of discharge piping and acid cleaning. The landfill cap repairs includes grading and placement of additional clay and topsoil in areas where the cap has thinned from settling and erosion. 

 

Budget/Fiscal Impact:  The increased maintenance required was not anticipated; therefore, not included in the approved Solid Waste Fund budget.  Funding for this required maintenance is available in the Fund Balance of the Solid Waste Fund.

Whereas, It is necessary to perform maintenance and repairs of the City’s landfill;

 

Whereas it is necessary to perform this work to comply with EGLE regulations;

 

Whereas, Amendment No. 4 to the Professional Services Agreement with Tetra Tech is necessary to perform additional identified repair and maintenance tasks related to the landfill;

 

Whereas, Funds to cover this expense are available in the Unrestricted Fund Balance of the Solid Waste Fund;

 

Whereas, It is necessary to retain the services of a professional engineering firm to assist the City with both routine and unanticipated landfill maintenance and repair, and oversight of the overall landfill system maintenance;

 

Whereas, Tetra Tech, Inc. has demonstrated the required experience, qualified professionals, and competitive fee schedule for the required services; and

 

Whereas, Tetra Tech, Inc. is in compliance with the requirements of the City’s Non-Discrimination and Living Wage ordinances.

 

RESOLVED, That City Council approves Amendment No. 4 in the amount of $124,907.73. to the professional services agreement with Tetra Tech, Inc. for the Ann Arbor Landfill Monitoring and Maintenance Program;

 

RESOLVED, That $124,908.00 be appropriated from the Solid Waste Unrestricted Fund Balance; thereby increasing the revenue and expenditure budgets of the Solid Waste Fund;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute Amendment No. 4 to the professional services agreement with Tetra Tech after approval as to substance by the City Administrator and approval as to form by the City Attorney; and 

 

RESOLVED, That City Council authorizes the City Administrator to take necessary administrative actions to implement this resolution.
