Resolution to Award Construction Contracts to True North Asphalt for up to $500,000.00 (approximately $250,000.00 annually) and CB Asphalt Paving for up to $500,000.00 (approximately $250,000.00 annually) for Street Cut and Miscellaneous Pavement Repair (ITB # 4624)
Memorandum
Attached for your approval is a resolution to award construction contracts to True North Asphalt and CB Asphalt Paving to perform street cut and miscellaneous pavement repairs for approximately to $250,000.00 each per fiscal year for two years. These contracts are used to perform permanent asphalt repairs for utility excavations, path maintenance, parking lots, and major and local road deficiencies.
ITB-4624 was advertised on the City’s Website and on the Michigan Inter-governmental Trade Network (MITN) website. Six (6) bids were received and publicly opened on April 16, 2020. True North Asphalt and CB Asphalt Paving were the lowest responsible bidders for street cut and miscellaneous pavement repairs. Two firms are being selected to enable the City to perform more repairs simultaneously and have flexibility in scheduling and managing demand.

Budget Impact: Funding is available in the approved FY 21 Public Works and Parks and Recreation’s operations and maintenance budgets and will be available in subsequent budgets if approved by Council. Costs will be allocated to the appropriate funding source based on the individual tasks performed under this contract.
Both True North Asphalt and CB Asphalt Paving comply with the City’s Non-Discrimination and Living Wage ordinances.
The agreements cover the period of June 15, 2020 through June 15, 2022 and may be extended for one 2-year period by agreement of the parties, subject to a 3% increase in unit prices and the annual appropriation of funds.

Whereas, Public Works would like to award construction contracts for street cut and miscellaneous pavement repairs to perform permanent asphalt repairs for utility excavations, path maintenance, parking lots, and major and local road deficiencies;
Whereas, Six competitive bids (ITB-4624) were received on April 16, 2020;
Whereas, True North Asphalt and CB Asphalt Paving were determined to be the lowest responsible bidders;
Whereas, Selecting two firms provides the City with flexibility in scheduling and managing work volume;
Whereas, The term of the proposed contracts with True North Asphalt and CB Asphalt Paving is for two years and up to approximately $250,000.00 each per year, subject to the availability of funding; and
Whereas, True North Asphalt and CB Asphalt Paving each comply with the City’s Non-Discrimination and Living Wage Ordinances;
RESOLVED, That Council approve 2-year construction contracts with True North Asphalt and CB Asphalt Paving for Street Cut and Miscellaneous Pavement Repair (ITB #4624) in the amount not to exceed $500,000.000 over the contract term of June 15, 2020 through June 15, 2022, subject to the annual appropriation of funds;
RESOLVED, That the City Administrator be authorized to extend the agreements for up to one 2-year period by agreement of the parties and subject to a 3% increase in unit prices and the annual appropriation of funds;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreements after approval as to substance by the City Administrator and approval as to form by the City Attorney; and
RESOLVED, That the City Administrator be authorized to take the necessary actions to implement this resolution including approval of needed Traffic Control Orders, night work authorizations, and other similar administrative approvals to allow the work under the contracts to proceed without delay.
