Resolution to Approve a Purchase Order for Hot Mix Asphalt (HMA) and Emulsion to Cadillac Asphalt, LLC ($399,080.00/$199,540.00 annually; ITB-4628)

Attached for your review and consideration for approval is a resolution authorizing City expenditure of up to $399,080.00 for the purchase of hot mix asphalt (HMA) and emulsion from Cadillac Asphalt, LLC.
The bid was advertised on the City’s Website and on the Michigan Inter-governmental Trade Network (MITN) website. One (1) bid was received and publically opened on May 13, 2020. The bid submitted by Cadillac Asphalt, LLC was reviewed and determined to be responsive.
The purchased HMA and emulsion will be used for normal street and path maintenance and for restoration of the same after work on City water supply, sewage disposal, and stormwater systems.
Budget Impact: Funding is available in the approved FY21 Major and Local Street Operation and Maintenance budgets, Sewage Disposal System, Stormwater System, and Water Supply System, and will be available in subsequent annual budgets if so approved by council.
Cadillac Asphalt, LLC complies with the City’s Non-Discrimination and Living Wage Ordinances.
This agreement is for July 1, 2020 through June 30, 2022 and may be extended for up to one (1) year, subject to the agreement of both parties and subject to the annual appropriation of funds.

Whereas, Public Works needs to purchase Hot Mix Asphalt (HMA) and emulsion for normal street and path maintenance and for restoration of the same after work on City water supply, sewage disposal, and stormwater systems;
Whereas, The City received one competitive bid (ITB-4628) on May 13, 2020;
Whereas, The bid submitted by Cadillac Asphalt, LLC was reviewed and determined to be responsive;
Whereas, The bid prices are firm through June 30, 2022;
Whereas, Cadillac Asphalt, LLC complies with the City’s Non-Discrimination and Living Wage Ordinances; and
Whereas, Sufficient funds have been budgeted in the approved FY21 Major and Local Street Operations and Maintenance budgets, Sewage Disposal System, Stormwater System, and Water Supply System, and will be available in subsequent annual budgets if so approved by council;
RESOLVED, That City Council approve the purchase order for hot mix asphalt (HMA) and emulsion from Cadillac Asphalt, LLC, as needed for the next two fiscal years not to exceed $199,540.00 annually;
RESOLVED, That the City Administrator be authorized to renew the agreement for one-year subject to agreement by both parties and the annual appropriation of funds; and
RESOLVED, That the City Administrator be authorized to take all necessary actions to implement this resolution.
