Resolution to Approve an Amendment to the Progressive Design-Build Agreement with J. Ranck Electric, Inc. for Phase 2 of the Water Treatment Plant SCADA System Modernization Project and Appropriate Water Supply System Fund Balance ($4,126,502.79) (8 Votes Required)
Memorandum
This memorandum and resolution request approval of an amendment to a progressive design-build agreement with J. Ranck Electric, Inc. to provide professional engineering services for the Water Treatment Plant Supervisory Control and Data Acquisition (SCADA) System Modernization Project (UT-WS-16-19) for a total of $4,126,502.79.
The SCADA System Modernization Project will replace over 20-year old legacy Programmable Logic Controllers (PLC’s) and SCADA computer systems with new, modern components capable of additional functionality and integration with other plant software packages and equipment. The PLC’s and associated equipment were installed in 1997 and production of all critical components has been discontinued by the manufacturer and are no longer supported. This project will improve the overall reliability of plant control functions, add more data logging and aggregation, integrate the SCADA system with other plant software applications, and comply with industry standard security protocols.
In September 2018, the City issued a request for proposal for the Design-Builder role in the Water Treatment Plant SCADA System Modernization Project. This project is a Progressive Design-Build Project that utilizes a Design-Builder to provide design services at a fixed price for Phase I of the project. At the completion of Phase I, the Design-Builder submits a not-to-exceed contract price to complete the balance of design and construction. This firm price is provided with open book pricing for consideration by the city.
The not-to-exceed contract price negotiated with the city at the conclusion of Phase 1, is $4,126,502.79.
The City worked collaboratively with the Design-Builder during Phase I to develop this contract price for the Phase II scope of work. This process has been detailed in an informational memo that is also on this meeting’s agenda.
Budget/Fiscal impact: Funds for this project in the amount of $4,126,502.79 are to be appropriated from available Water Supply System Fund Balance to the project budget. This project was a high priority project in the Water Supply System Capital Improvement Plan and is included in the FY21 revised capital improvements plan as passed by Planning Commission.
The total estimated project cost of $5,458,000.00 includes:
Phase I Design by Design-Build Team - $ 210,198.00
Owners Advisor services - $ 376,796.00
Phase II Design and Construction services - $4,126,502.79
Phase II Contingency - $ 594,503.21
City Labor- $ 150,000.00
J. Ranck Electric, Inc. complies with the requirements of the City’s Non-Discrimination and Living Wage ordinance.

Whereas, The City initiated a progressive design-build project to execute the WTP SCADA Modernization project;
Whereas, The SCADA System Modernization Project is necessary to improve the overall reliability of plant control functions, integrate the SCADA system with other plant software applications, and comply with industry standard security protocols;
Whereas, Existing SCADA system components are no longer supported by the manufacturer making service and repair difficult;
Whereas, The final project design and construction pricing that are reflected in the Guaranteed Maximum Price (GMP) and allowances pricing developed in Phase I were found to be acceptable; and
Whereas, J. Ranck Electric, Inc. complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances;
RESOLVED, That the Progressive Design-Build Agreement with J. Ranck Electric, Inc. is approved in the amount of $4,126,502.79;
RESOLVED; That a contingency in the amount of $412,650.28 is approved to finance change orders to the progressive design-build agreement to be approved by the City Administrator;
RESOLVED, That $4,126,502.79 be appropriated from Water Supply System Fund Balance to the SCADA Modernization Project (UT-WS-16-19);
RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the Progressive Design-Build Agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney;
RESOLVED, That the City makes the following declaration for the purposes of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the internal Revenue Code of 1986, as amended, that the City reasonably expect to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
