Memorandum

Attached for your review and approval is a change order to the Construction Contract with Doan Construction Co. (Bid No. 4522) for the 2019 Annual Sidewalk Repair Project.

 

The project consisted of repair or maintenance of sidewalks in approximately 20% of the City in 2019, as part of a 5-year program to maintain and repair the City’s sidewalk system. The project also includes some replacement of sidewalk-curb ramps to meet accessibility requirements at requested locations throughout the City.  The attached map depicts the areas repaired and maintained in 2019.

 

As part of this project, City staff estimate the quantity of work to be performed by the contractor each year in advance of construction. During construction, it became clear that the final area to be maintained in the 2019 areas (Areas 2019-02 and 2019-01 on the attached map) could not be completed within the existing contract amount ($658,511.54).  Contract Change Order No. 1 ($62,416.00) was within the Contract’s contingency of $66,000.00 and approved administratively. Contract Change Order No. 2 ($312,141.00) will increase the total contract amount to $1,033,068.54.

 

Doan Construction Company has submitted all required Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Non-Discrimination, Prevailing Wage and Living Wage ordinances.

 

Budget Impact:  Funding for the project comes primarily from the Street, Bridge, and Sidewalk Millage. Other funding sources for work that is done in association with the Sidewalk Repair Project includes: Major and Local Street Funds; County Road Millage; Michigan Department of Transportation; the University of Michigan, various contributions from non-taxable parcels, and various departmental budgets within the city of Ann Arbor.

Whereas, The City of Ann Arbor Capital Improvements Plan (CIP) includes the 2019 Annual Sidewalk Program Project;

 

Whereas, The project maintains and repairs approximately 20% of the City’s pedestrian facilities annually;

 

Whereas, It is necessary to increase of the contract amount with Doan Construction Company in order to complete the areas scheduled for repair in 2019;

 

Whereas, Doan Construction Company was awarded a construction contract for the 2019 Annual Sidewalk Repair Project in the amount of $658,511.54;

 

Whereas, The existing contingency in the amount of $66,000.00 is insufficient to cover the addition of Change Order No. 2; 

 

Whereas, Funds for Change Order No. 2 are available in the approved Street, Bridge, and Sidewalk Millage Fund;

 

Whereas, Doan Construction Company has submitted all required Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Non-Discrimination, Prevailing Wage and Living Wage ordinances; and

 

Whereas, The work encompassed by this change order is done in accordance with the existing competitively-bid unit rates in the contract;

 

RESOLVED, That Change Order No. 2 to the construction contract with Doan Construction Company for the 2019 Annual Sidewalk Repair Project be approved in the amount of $312,141.00 for additional amounts of work under the contract; and

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
