Resolution to Settle Peters Building Co. v. City Of Ann Arbor

Whereas, The City wants to resolve the Peters Building Co. v. City of Ann Arbor Circuit Court Case by approving development on the site recently submitted as a PUD rezoning and site plan;
RESOLVED, That City Council supports the approval of a Consent Judgment that incorporates the following terms:
• Approval of development on the site consistent with the PUD zoning, supplemental regulations and site plan recently submitted to the City;
• A mutual release of all claims that would end the litigation;
RESOLVED, That the City Administrator and City Attorney negotiate a Consent Judgment that would dismiss all claims in the lawsuit for Council to review and approve at the earliest possible opportunity.
