Memorandum

Attached for your approval is a resolution authorizing a contract with Niles Industrial Coatings, LLC in the amount of $70,768.00 and to approve a $14,000.00 contingency for painting the interior of the Retention Building at the City’s Wastewater Treatment Plant (WWTP).  The WWTP hired Great Lakes Environmental Services, Inc. to perform removal of loose lead based paint in the Retention Building in the fall of 2018, which included the application of a primer coat to encapsulate the remaining lead paint and prevent further paint peeling.  The work to be performed under this contract is to apply a primer and top coat to fully encapsulate this lead paint.

 

ITB No. 4587 was advertised on the City’s Website and on the Michigan Inter-governmental Trade Network (MITN) website. The scope of work included a base bid for painting the Retention Building interior walls, ceiling, pipes, and conduits, and an alternate bid that also included painting metal stairways within the building.  Plant staff added stairway painting as an alternate to address all remaining areas requiring encapsulation of lead based paint within the building.  If the contractor alternate bids were less than the $120,000.00 budgeted in FY20 for this work, WWTP staff intended to seek City Council approval of a contract based on the Alternate Bids.   Five (5) bids were received and publicly opened on June 27, 2019.

 

The following painting contractors submitted bids for ITB No. 4587:

Staff reviewed the bids, compared them to ITB No. 4587 specifications and recommends that Niles Industrial Coatings, LLC be approved as the lowest responsible bidder to supply painting services for the Retention Building at the WWTP based on its Alternate Bid.

 

Niles Industrial Coatings, LLC complies with the City’s Non-Discrimination and Living Wage ordinances.

 

Budget/Fiscal Impact:  Funds to finance this contract are included in the approved FY20 WWTP Operation and Maintenance Budget for the Sewage Disposal System.

Whereas, Niles Industrial Coatings, LLC was determined to be the lowest responsible bidder for painting the interior of the Retention Building at the WWTP based on the Alternate Bids submitted;

 

Whereas, Unforeseen needs may arise requiring additional painting, WWTP staff are requesting a contingency of $14,000.00 to fund additional necessary services;

 

Whereas, Sufficient funds have been budgeted in the approved FY20 WWTP Operations and Maintenance Budget for the Sewage Disposal System; and

 

Whereas, Niles Industrial Coatings, LLC complies with the requirements of the City’s Non-Discrimination and Living Wage Ordinances;

 

Resolved, That City Council approve a Contract with Niles Industrial Coatings, LLC for painting services as specified in ITB No. 4587 and based on the Alternate Bid in the amount not to exceed $70,768.00;

 

RESOLVED, That the City Administrator be authorized to approve additional change orders to complete the work not to exceed $14,000.00 in order to fund unforeseen additional necessary services and to satisfactorily complete this project;

 

RESOLVED, That the City Administrator be authorized and directed to execute the contract with Niles Industrial Coatings, LLC, subject to approval by the City Administrator as to substance and subject to approval by the City Attorney as to form; and

 

RESOLVED, That the City Administrator be authorized to take the necessary actions to implement this resolution.
