Memorandum
There is a resolution before you to accept an easement for pedestrian access from The District Library Board of the Ann Arbor District Library for the construction and maintenance of a  sidewalk along the west side of Traverwood Drive.   
 
The terms and conditions of the grant of easement have been reviewed and approved by the Private Development Unit of the Public Services Area.
Acceptance of the grant of easement is recommended.

Body
Whereas, The District Library Board of the Ann Arbor District Library, an entity organized and existing pursuant to the Michigan District Library Establishment Act,  is the owner in fee simple of property located in the City of Ann Arbor, Washtenaw County, Michigan, as described in the Washtenaw County Records at Liber 4481, Page 7, recorded May 26, 2005;
 
Whereas, A Resolution of The Board of Trustees of the Ann Arbor District Library, dated April 27, 2009, authorizes the execution and delivery of a perpetual easement to the City for the purpose of pedestrian access; and
 
Whereas, The District Library Board of the Ann Arbor District Library has delivered an easement for pedestrian access to encumber and run with the land and burden the respective property perpetually, being more particularly described as follows:
 
Commencing at the Southwest Corner of Section 15, T.2S., R.6E., City of Ann Arbor, Washtenaw County, Michigan; thence N 88°23'50" E 1313.45 feet along the South line of said Section 15; thence N 00°54'42" W 1774.62 feet along the West line of the East 1/2 of the Southwest 1/4 of said Section 15; thence N 88°09'15" E 380.00 feet; thence S 66°12'50" E 231.47 feet to the westerly line of Traverwood Drive (70 feet wide); thence N 23°47'10" E 44.32 feet along said westerly line to the Place of Beginning:  thence N 50°49'25" W 38.92 feet; thence N 37°42'27" E 110.56 feet; thence N 50°49'25" W 2.33 feet; thence N 37°40'29" E 215.45 feet; thence S 52°27'52" E 1.34 feet; thence N 37°32'08" E 189.67 feet to the southerly line of Huron Parkway (width varies); thence S 51°49'25" E 5.90 feet to the southwesterly intersection of Huron Parkway and Traverwood Drive; thence the following two courses along said westerly line S 37°32'08" W 308.03 feet and 23.15 feet along the arc of a curve to the left, said curve having a radius of 608.00 feet, a central angle of 02°10'53", and a chord which bears S 36°26'54" W 23.15 feet; thence leaving said westerly line of Traverwood Drive S 37°39'56" W 50.83 feet; thence S 50°49'25" E 2.31 feet; thence S 37°42'27" W 123.35 feet; thence S 50°49'25" E 28.30 feet to the westerly line of Taverwood Drive; thence S 23°47'10" W 10.88 feet to the Place of Beginning.  Being part of the Southwest 1/4 Section 15, Ann Arbor Township, T.2S., R.6E., Washtenaw County, Michigan.
 
RESOLVED, That the City hereby accept said easement.
