Memorandum
Attached for your review and action is a resolution to approve the purchase of a dehumidification unit from BMIL Technologies in the amount of $136,874.00, per bid #4017.  This purchase is part of a more extensive project that will include the installation of the unit, a fire suppression system, and renovation of locker rooms.  The unit is being purchased prior to the remainder of the project elements to accommodate the long lead time for fabrication and delivery and to assure that the ice arena facility opens on schedule in September.  The dehumidification system will help to prolong the life of the rink infrastructure by decreasing rusting, will improve the air quality in the rink, and enhance ice conditions for skating.  The budget for the entire project is $550,000.00 including design and engineering fees.
 
Bids were advertised on the City's website and on BidNET and sent to qualified manufacturers.  Three companies submitted bids for the project as follows:
 
Johnson Controls, Inc. - $117,861.00
BMIL Technologies, LLC* - $136,874.00
NIX Contracting, LLC - $148,759.00
*Lowest responsible bidder
 
Although Johnson Controls was the low bidder, their bid was non-compliant.  The controls that were specified for the dehumidifier were not included in the bid, and proposed sound level was above what was specified, which is important because the unit will be located inside the ice arena.  Therefore, BMIL Technologies was the lowest responsible bidder.  This bid was within the estimated dollar amount for the unit.
 
BMIL Technologies, LLC received Human Rights approval on April 14, 2009.  The contractor complies with the living and prevailing wage ordinance.
 
Funding for this project is included in the approved FY 09 Park Rehabilitation and Development Millage Budget which has been carried forward in the approved FY10 budget as a multi-year project.

Whereas, Renovations to Veterans Memorial Park Ice Arena/Pool Facility are scheduled in the Park and Recreation Open Space Plan, 2006-2011;
 
Whereas, The dehumidification unit will help to prolong the life of the rink infrastructure by decreasing rusting, will improve the air quality in the rink, and enhance ice conditions for skating;
 
Whereas, Competitive bids were sought by the Procurement Office to purchase a dehumidification unit for Veterans Memorial Park Ice Rink with bids received on April 9, 2009 and BMIL Technologies, LLC was identified as the lowest responsible bidder;
 
Whereas, Funding for this project were planned for  and  included in the approved Park Rehabilitation and Development Millage Budget and carried forward in the approved FY10 budget as a multi-year project; and
 
Whereas, BMIL Technologies, LLC received Human Rights approval on April 14, 2009 and complies and the living wage and prevailing wage requirements;
 
RESOLVED, That City Council approve the purchase of a dehumidification unit, per bid #4017 from BMIL Technologies, LLC for $136,874.00; and
 
RESOLVED, That the City Administrator is authorized to take all administrative actions to implement this resolution.
