Memorandum
Attached for your review and action is a resolution to approve a contract with Baseline Constructors, Inc. in the amount of $336,350, per bid #4029.  The project includes the installation of a dehumidification unit to help prolong the life of the rink infrastructure as well as enhancing ice conditions for skating, a fire suppression system which is required by code, and renovation of locker rooms that have deteriorated and are in need of improvement.  The dehumidification unit is being purchased separately from the remainder of the project elements to accommodate the long lead time for fabrication and delivery and to assure that the facility opens on schedule.  The budget for the entire project is $550,000 including design and engineering fees and the purchase of the dehumidification unit.
 
Bids were advertised on the City's website and on BidNET and sent to qualified contractors.  Five companies submitted bids for the project as follows:
 
      Baseline Constructors*      $368,800.
      Irish Construction      $393,000.
      Construction Solutions, Inc.      $398,400.
      Heaney General Contracting      $399,000.
      Stenco Construction Co.      $419,100.
 
*Lowest responsible bidder.
 
Baseline Constructors, Inc. provided the lowest bid, however, their bid was not within the available budget which necessitated altering the scope of work slightly to bring the project from the bid amount of $368,800 to $336,350.  This included some material changes, eliminating some locker room fixture upgrades, and not painting the piping of the fire suppression system.  The alterations did not change the integrity of the project.
 
Baseline Constructors, Inc. received Human Rights Approval on June 3, 2009.  The contractor complies with the living and prevailing wage ordinance.
 
Funding for the project was planned and included in the approved Park Rehabilitation and Development Millage FY09 budget and carried forward in the approved FY 10 budget as a multi-year project.

Whereas, Renovations to Veterans Memorial Park Ice Arena are scheduled in the Park and Recreation Open Space Plan, 2006-2011;
 
Whereas, Improvements to the Ice Arena include renovation of the locker rooms, installation of a fire suppression system, and installation of a dehumidification system;
 
Whereas, Competitive bids were sought by the Procurement Office for Veterans Memorial Park Ice Arena with bids received on June 2, 2009 and Baseline Constructors, Inc. was identified as the lowest responsible bidder;
 
Whereas, The improvements will prolong the life of the rink infrastructure and provide an enhanced customer experience;
 
Whereas, Funding for the project was planned and included in the approved Park Rehabilitation and Development Millage FY09 budget and carried forward in the approved FY 10 budget as a multi-year project; and
 
Whereas, Baseline Constructors, Inc. received Human Rights approval on June 3, 2009 and complies and the living wage and prevailing wage requirements;
 
RESOLVED, That City Council approve the contract with Baseline Constructors, Inc., per bid #4029 in the amount of $336,350.00, a construction contingency in the amount of $33,635.00 (10%) to cover potential contract change orders, and a total construction budget of $369,985.00 for the life of the project without regard to fiscal year;
 
RESOLVED, That the City Administrator be authorized to take all necessary administrative actions to implement this resolution including the authority to approve change orders within the approved contingency; and
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney.
