Resolution to Award Contract for the Water Treatment Plan UV Disinfection System Project to Weiss Construction Co., LLC ($2,582,770.00)  

Memorandum

This memorandum and resolution requests approval to award a contract to Weiss Construction Co., LLC (Weiss) for the Water Treatment Plant (WTP) UV Disinfection System Project.

 

An ITB for the UV Disinfection System was advertised through standard purchasing procedures as well as on the City’s website and on MITN.  An additional ad was posted for a minimum of 30 days pursuant to the State of Michigan requirements for DWRF projects. 

 

In 2017, the Michigan Department of Environmental Quality (MDEQ) notified the City its drinking water source contains levels of Cryptosporidium (a waterborne parasite), which requires additional protection to comply with the EPA Long-term 2 Enhanced Surface Water Treatment Rule (LT2) drinking-water regulations.  MDEQ has stated to the City that it must comply by June 2020.

 

An ultraviolet light (UV) disinfection system is being implemented to provide the required disinfection and will allow the City to comply with the MDEQ’s deadline.  This Project includes the installation of new piping and UV disinfection reactors, electrical and controls modifications, and startup and testing of new equipment.

 

The Invitation to Bid was advertised on the City’s website and on MITN.  On February 28, 2019, the City received 1 bid, from Weiss Construction Co., LLC.  Staff has determined that Weiss’ bid is responsible and within 1% of the Engineer’s Estimate.  Since Weiss submitted a responsible bid in the amount of $2,582,770.00, it is recommended that its bid be accepted, and that Weiss be awarded the Contract for the WTP UV Disinfection System project.

 

Budget/Fiscal Impact: This project is included in the Water Supply System Capital Improvement Budget.   The City is pursuing a low interest loan from the MDEQ Drinking Water Revolving Fund for this project. 

 

Weiss complies with the City’s Conflict of Interest, Living Wage and Non-Discrimination Ordinances.

Whereas, The Water Treatment Plant Disinfection System Project will ensure compliance with the EPA LT2 drinking water regulation for Cryptosporidium and compliance with the MDEQ June 2020 deadline related to the same;

 

Whereas, After the advertising on the City’s website and on MITN, one bid was received from Weiss Construction Co., LLC and has been evaluated as a responsible bid in the amount of $2,582,770.00;

 

Whereas, This Project is in the application process for the Drinking Water Revolving Loan Fund (DWRF) Program;

 

Whereas, The Water Treatment Plant UV Disinfection System Project is included as a project in the Water Supply System Capital Improvement Plan;

 

Whereas, Funding for this work is approved Water Supply System Capital Budget;

Whereas, Funding is to be advanced from the Water Supply Systems Operating Fund balance to be repaid pending the sale of water revenue bonds through the DWRF Program;  and

 

Whereas, Weiss Construction Co., LLC complies with the City’s Conflict of Interest, Living Wage and Non-Discrimination Ordinances;

 

RESOLVED, That Council award the contract for the Water Treatment Plant UV Disinfection System Project to Weiss Construction Co., LLC, in the amount of $2,582,770.00;

 

RESOLVED, That a contingency in the amount of $260,000.00 be approved to finance change orders to the contract with Weiss Construction Co., LLC to be approved by the City Administrator;

 

RESOLVED, That funding be available from the Water Supply System Capital Improvement Budget, and the funds are available without regard to the fiscal year;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney;

 

RESOLVED, That the City make the following declaration for the purpose of complying with the reimbursement rules of Treas. Reg. 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and

 

RESOLVED, That the City Administrator be authorized to take all necessary actions to implement this resolution including execution of any authorized renewals and any changes or amendments that do not exceed the contingency amount.
