Resolution Authorizing Storm Sewer Improvement Charges for 2965 Kimberley Rd. ($3,768.15)

Memorandum

Your approval is requested to levy storm sewer improvement charges totaling $3,768.15 on the property known as 2965 Kimberley Rd. This parcel was annexed in 2017. The storm sewer main was constructed by the city in 1972.

 

City of Ann Arbor Code Chapter 12, Section 1:279, levies against newly-annexed properties their fair share of the cost of local public improvements that benefit them in the form of a local improvement charge.  It is therefore recommended that Council levy this improvement charge in an amount equal to $3,768.15, which may be paid in 4 annual installments, with interest accruing at 3.06% per annum on the unpaid balance.

Whereas, The property at 2965 Kimberley Road annexed into the City of Ann Arbor on September 26, 2017;

 

Whereas, Improvement charges for the storm sewer in Packard Road constructed in 1972 are due. Cost forwarded improvement charges are:  $626.98*6.01 (cost forwarding factor) = $3,768.15 for 2965 Kimberley Road; and

 

Whereas, Pursuant to Section 1:279, Chapter 12, of the Code of the City of Ann Arbor, the fair share of the cost of said improvement is levied against certain properties and the fair share for this property has not been previously paid;

 

RESOLVED, That Council levy an improvement charge against the following property which is specifically benefited by the above improvements:

RESOLVED, That the improvement charge levied be $3,768.15;

 

RESOLVED, That this improvement charge may be paid in 4 equal installments with the first due on July 1, 2019, and the 3 subsequent installments due on July 1 of each and every year thereafter, with the deferred installments of the improvement charge to bear interest at the rate of 3.06% per annum on Storm sewer;

 

RESOLVED, That the Public Services Area be directed to send a copy of this resolution by electronic mail or first class mail to the owners of the property and to promptly have this resolution recorded in the office of the Register of Deeds of Washtenaw County, Michigan; and

 

RESOLVED, That this levied Improvement charge is to be invoiced to the owner, Marc Maxey, of the property known as 2965 Kimberley Rd., City of Ann Arbor, Washtenaw County, Michigan 48104, and to be credited in the amount of $3,768.15 to Fund 0069-018-1000-0000-7151
