Resolution to Approve a Collaborative Agreement with the Treeline Conservancy for Development of the Treeline Trail

Memorandum

This resolution approves a Collaborative Agreement with the Treeline Conservancy.

 

The purpose of the Collaborative Agreement is to establish a general framework for a public/private collaboration between the City and the Conservancy. It will assist in defining the relationship between the parties to ensure that the goals of each are accomplished and driven by a shared desire to guide and advance the implementation of the Treeline - Allen Creek Urban Trail Master Plan, which was adopted by City Council on December 18, 2017.

 

The agreement sets forth the general expectations for implementation of the Treeline Trail. In general, the agreement envisions that the City will seek grants and other funding and will own the infrastructure of the Treeline, while the Treeline Conservancy will provide support in the form consultation, advice, and donations and fundraising for property acquisition, design, construction, and maintenance. The City and Conservancy may enter other agreements as needed for specific purposes, such as design and construction of particular phases or operation and management. If such an agreement is appropriate, it would be subject to separate City approval.

 

The Treeline Conservancy has emphasized and City staff concurs that having this agreement to demonstrate a public/private collaboration between the City and Conservancy will provide additional support in grant applications and solicitation of donors.

 

Budget/Fiscal Impact:  None. The agreement sets forth a framework and the general roles of the City and Treeline Conservancy for approaching development of the Treeline and does not commit the City financially.

 

Approval is recommended.

Whereas, City Council unanimously adopted the Treeline - Allen Creek Urban Trail Master Plan on December 18, 2017 as part of the City’s overall Master Plan;

 

Whereas, The City wishes to engage in public/private collaborations as a key means to advance the implementation of the Treeline;

 

Whereas, The Treeline Conservancy is a 501(c)(3) nonprofit whose vision statement states that it is “dedicated to the planning, construction, fundraising, and sustainable maintenance of the Treeline;”

 

Whereas, The City and the Conservancy have a shared desire to guide and advance the implementation of the Treeline Master Plan;

 

Whereas, The City and the Conservancy wish to memorialize their relationship by setting forth a series of mutual expectations;

 

Whereas, Memorializing the relationship between the City and Conservancy will strengthen funding requests and increase grant funding opportunities for the Treeline; and

 

Whereas, A Collaborative Agreement provides a mechanism to establish a general framework for cooperation and establish a formal relationship between the City and the Conservancy at this early stage of implementation.

 

RESOLVED, That City Council approves a Collaborative Agreement with the Conservancy after approval as to substance by the City Administrator and as to form by the City Attorney;

 

RESOLVED, That the Mayor and City Clerk are authorized and directed to sign the Collaborative Agreement on behalf of the City; and

 

RESOLVED, That the City Administrator is authorized to take all appropriate action to implement the Collaborative Agreement.
