Resolution to Approve an Agreement with the Michigan Department of Transportation for the Citywide Pedestrian Safety Improvement Project ($195,300.00)

Attached for your review and approval, please find a resolution to approve an agreement between the City and the Michigan Department of Transportation (MDOT) for pedestrian safety improvements at various locations in the city. The agreement is required so that this project can be performed as a federal aid project.
The project consists of installing three (3) pedestrian refuge islands, countdown pedestrian signals at twelve (12) locations and various crosswalk signing and pavement marking improvements. The pedestrian refuge islands will be constructed on S. Main at Oakbrook, Packard at Woodmanor and Ellsworth at Jonathon Ct. Pedestrian signal upgrades will take place primarily in the downtown area at locations such as William and Fourth.
The construction plans were prepared by the staff and submitted to MDOT for their May 15, 2009 bid letting. The project construction is estimated at $244,100.00 with $195,3000.00 in Federal grant and $48,800.00 in local participation. Construction is scheduled to begin in June 2009 and continue until September 2009. Like all such projects, MDOT will award the construction contract and the City of Ann Arbor will act as the project engineer.
One requirement for this type of project is that the City enters into an agreement with the State stipulating the funding split and other rights and responsibilities of the parties. It is the same form of agreement that we have used on other federally funded projects. Federal Safety Hazard Elimination Funds will supply 80% of the participating construction cost. The remaining 20% of the construction contract, 100% design, construction engineering, testing, and all non-participating items of work will be funded from the City of Ann Arbor Major Street Fund as shown below:

Whereas, The Federal Highway Administration has allocated funds for the installation of pedestrian safety improvements on various roadways within the City of Ann Arbor;
Whereas, Funds for this project are available in the City's approval capital budget; and
Whereas, The construction and installation of improvements will enhance pedestrian traffic safety;
RESOLVED, That the City Council authorizes an Agreement with the Michigan Department of Transportation for the Citywide Pedestrian Safety Improvement Project in an amount of $195,300.00;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to form by the City Attorney, and approval as to substance by the City Administrator;
RESOLVED, That a total of $57,800.00 from the Major Street Fund be available for the life of the project, to be available without regard to fiscal year; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
