Memorandum
This is to recommend approval of the attached resolution to amend the Professional Services Agreement with Midwestern Consulting, L.L.C. for engineering design and construction services by $111,870.00 for a total of $161,870.00.
 
A Professional Services Agreement with Midwestern Consulting, L.L.C. for $24,728.38 was established on December 4, 2006, in order to investigate design alternatives and was amended for an additional $25,271.62 on July 16, 2007 to provided for the project's design and the preparation of construction plans and specifications.
 
The Project Management Services Unit issued a Request for Proposal (RFP #649) in November of 2006 for a professional engineering firm to provide preliminary design alternative options and engineering drafting services for the proposed path.  In response to our request, we received eight proposals.  A review team composed of City staff evaluated the proposals and selected Midwestern Consulting, L.L.C. based on their proposed work plan, staff qualifications, past involvement with similar projects, and competitive fee schedule.  
 
The purpose of this project is to construct a 10-foot wide, non-motorized asphalt path along the north side of Washtenaw Avenue between Glenwood and Toumy.   Washtenaw Avenue is a heavily traveled arterial under the jurisdiction of the Michigan Department of Transportation (MDOT).  The construction of a non-motorized path alongside this arterial roadway will create a safe, convenient and comfortable environment for bicycle and pedestrian travel along this corridor.  The development of this path will create a new connection between the existing sidewalk systems that links and serves the downtown area and the Washtenaw/Huron Parkway commercial area to the east.  In addition to accommodating non-motorized travel along the corridor, the new path will enable citizens that live adjacent to the facility to more safely access the AATA service that runs along Washtenaw Avenue.  Construction is currently planned for the Fall of 2009.
 
The Washtenaw Avenue Non-Motorized Path Special Assessment Resolution 1 was approved on February 21, 2006 (R-55-2-06) and authorized the development of plans, specifications and cost estimates for non-motorized path improvements.  The City has been approved for a MDOT Transportation Enhancement Grant of up to $538,527 for the construction of this project.  In addition, the City has been approved for a MDOT Surface Transportation Program - Urban grant of up to $460,000 for the construction of this project.  The remainder of the construction costs and all of the project's design costs will be derived from the City's Approved Capital Budget and special assessment funds.  This project is consistent with Council's Alternative Transportation initiative, and is consistent with the 2007 Non-Motorized Transportation Plan recommendations.  
 
The amendment to the Professional Services Agreement with Midwestern Consulting, L.L.C. includes $32,120.00 for the collection of additional topographic survey; the survey and design of 600 linear feet of water main from Glenwood to Arlington; the final preparation of proposed grading permit documentation; and preparation of the final bid documents in accordance with MDOT Specifications.   In addition, this amendment includes $79,750.00 for construction engineering services including construction inspection, surveying and engineering.
 
Midwestern Consulting, L.L.C. received Human Rights and Living Wage approval on April 28, 2009.  
 
Sufficient funds are available in the approved capital  budget for the design and construction engineering services included in the proposed amendment to the Professional Services Agreement.

Whereas, The City Council through the Resolution R-176-5-03 has established a policy direction to establish a connected network of bicycle lanes along main commuter routes within ten years;
 
Whereas, The construction of a Non-motorized Path along Washtenaw Avenue in the public right-of-way from Tuomy Road to Glenwood Road will provide the City properties along Washtenaw Avenue with a safe non-motorized facility and benefit those City properties consistent with Resolution R-176-5-03;
 
Whereas, Michigan Department of Transportation has approved the Washtenaw Ave non-motorized path from Tuomy Road to Glenwood Road for $538,527.00 of Federal Funding from the State's Transportation Enhancement Grant Fund;
 
Whereas, Michigan Department of Transportation has approved the Washtenaw Ave non-motorized path from Tuomy Road to Glenwood Road for $460,000 of Federal Funding from the State's Surface Transportation Program - Urban Grant Fund;
 
Whereas, The Transportation Enhancement Grant requires the City of Ann Arbor to complete planning and design processes;
 
Whereas, Midwestern Consulting, L.L.C. has provided preliminary professional engineering services, which included reviewing existing information and topographic survey data; identifying areas of concern; and developing conceptual design alternatives for stabilizing the banks;
 
Whereas, The amendment to the existing Professional Services Agreement with Midwestern Consulting, L.L.C. will be increased by $111,870.00 to a total of $161,870.00 and will include the collection of additional topographic survey; the survey and design of 600 linear feet of water main from Glenwood to Arlington; the final preparation of proposed grading permit documentation; and preparation of the final bid documents in accordance with MDOT Specifications; and construction engineering services including construction inspection, surveying and engineering;
 
Whereas, Midwestern Consulting, L.L.C. received Human Rights and Living Wage approval on April 28, 2009; and
 
Whereas, Sufficient funds for the project design and construction are available in the City's Approved Capital Budget;
 
RESOLVED, That City Council approves amending the Professional Services Agreement dated December 4, 2006 with Midwestern Consulting, L.L.C. in an amount of $111,870.00.
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to form by the City Attorney and approval as to substance by the City Administrator; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
