Memorandum

Approval is requested of Amendment No. 2 of the Agreement with White Buffalo, Inc. for Wildlife Management Services (“Agreement”) to increase the amount expendable in FY19, update insurance requirements, and extend the Agreement through FY20 to bring the Agreement’s term in line with the Michigan Department of Natural Resources (MDNR) permit. 

 

Budget/Fiscal Impact:   Sufficient Program Funds were budgeted and approved in the FY19 Deer Management Program costs to cover the $90,635 cost (plus contingency) for FY19 under Amendment No. 2.  It is anticipated that $75,000 (plus applicable contingency) will be planned and budgeted in FY20 under Amendment No. 2. 

 

The City of Ann Arbor is in preparing for its Deer Management Program during the coming winter to address deer impacts in selected areas.  The City continues to work under an MDNR issued “research” permit that allows White Buffalo, Inc. to cull and sterilize deer in accordance with the permit.  In addition, the City is continuing its educational efforts and signage as part of a three-pronged strategy to deer management.  The City is also continuing to invest in the collection of data to monitor the impacts of these efforts.

 

On July 3, 2017, City Council approved a two-year contract with White Buffalo, Inc. for Deer Management Program Services (R-17-258).  Funding for these services was budgeted at a NTE $170,000.00/yr. although for FY19, Amendment No. 1 to the Agreement (R-17-1619) provided a NTE contract amount of $75,000.  The proposed Amendment No. 2 increases that NTE amount to $90,635 (plus requested contingencies), and extends the Agreement through FY20, with a NTE amount of $75,000 (plus requested contingencies), to bring the Agreement’s term in line with the MDNR permit.  Amendment No. 2 also increases the insurance required of White Buffalo.

 

City Administration recommends approval of Amendment No. 2 to the White Buffalo, Inc. Agreement.

Whereas, White Buffalo, Inc.is operating under an Agreement with the City and an approved research permit from the MDNR to provide wildlife management services to the City specific to deer;

 

Whereas, Amendment No. 1 to such agreement provided a NTE contract amount of $75,000 in FY19, which is insufficient to meet FY19 objectives; and

 

Whereas, The proposed Amendment No. 2 will increases that NTE amount for FY19 to $90,635 (plus requested contingencies), extends the Agreement through FY20, with a NTE amount of $75,000 (plus requested contingencies) for FY20, and increases the insurance required of White Buffalo;

 

RESOLVED, That City Council approve the attached Amendment No. 2 of the Agreement with White Buffalo, Inc. and authorize $90,635 to be expended in FY19 and $75,000 to be expended in FY20, under the terms of the original Agreement as amended;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said Amendment No. 2, subject to approval as to substance by the City Administrator and approval as to form by the City Attorney;

 

RESOLVED, That the City Council approve a ten percent (10%) contingency on such Amendment No. 2, subject to availability of budgeted Program Funds, to be subject to City Administrator approval; and

 

RESOLVED, That the City Administrator be authorized to take all necessary actions to implement this Resolution, including the execution of any Letter of Authority required by the Michigan Department of Natural Resources in connection with permit activities on City property and Work Statements for specific program services within the approved contract amount.
