Resolution to Accept an Amendment to a Public Utilities System Easement at Forsythe Middle School and Wines Elementary School from The Public Schools of the City of Ann Arbor (8 Votes Required)

Memorandum

This amendment expressly authorizes the City to install data communication lines in an existing Public Utilities Easement.

 

This amendment is conveyed without cost to the City. Acceptance is recommended.

Body

Whereas, The Public Schools of the City of Ann Arbor (AAPS) is the owner of property commonly known as Forsythe Middle School and Wines Elementary School at 1655, 1701 and 1715 Newport Road;

 

Whereas, AAPS granted the City a permanent easement for a Public Utilities System in a grant of easement dated August 11, 2008, recorded January 22, 2009, in Liber 4714, page 323, Washtenaw County Records (“Easement”);

 

Whereas, In a letter dated March 14, 2017, Grantor consented to the City’s co-location of data communications lines within the Easement and the City has installed the data communication lines; and

 

Whereas, AAPS has signed an amendment to the Easement that expressly allows conduit, data communication lines, and related appurtenances;

 

RESOLVED, That the City of Ann Arbor hereby accept this amendment to the Easement.
