Attached for your review are proposed amendments to the Solid Waste Regulations as enabled by Section 2:10 of Chapter 26 of the City Code.

These amendments deal primarily with the following issues:

1. Implementation of the Commercial Waste Franchise: All commercial locations needing refuse dumpsters will be required to use the franchise hauler (Waste Management) unless an exemption is secured. The regulations clarify when the quarterly rates will be charged, as well as guidelines for developing them.
2. Existing City-Subsidized Commercial Dumpster Service: Existing commercial locations receiving the City-subsidized $39/month service will be transitioned to the franchise hauler, with a subsidy schedule that will be gradually phased out by July 1, 2012.
3. Dumpster Service for Non-profit organizations: Non-profit organizations that are defined as public charities under 509(a)(2) will be eligible for dumpster service at no charge. They will be serviced by the franchise hauler. Other non-profits that are currently getting dumpster service at no charge, such as private schools and churches, will be billed at the City-subsidized rate as in 2 above that is likewise being phased out by July 1, 2012. These locations will also be serviced by the franchise hauler.
4. Commercial Recycling Enforcement provisions: Commercial recycling will be implemented through voluntary compliance through July 1, 2011. After that date, enforcement and reporting provisions mandating recycling may be implemented.
5. Vegetative Food Waste Composting: As allowed by the MDEQ and in its agreement with Pittsfield Township, the City has been collecting vegetative food waste from a limited number of commercial locations, as well as a University of Michigan pilot program. This regulation change will allow residents to place vegetative food waste in their compost carts for collection and processing.
