Resolution to Place Delinquent Water Utilities Charges on the July 2009 Tax Roll ($69,341.96)
Memorandum
Your approval is requested to place delinquent Water Utilities charges, which have remained unpaid for six months or more, on the July 2009 tax roll.

These delinquent charges are a lien on the property served as provided by the State of Michigan Public Act 94 of 1933. Any such charge delinquent for six months or more is placed on the City’s tax roll with a 10% penalty pursuant to the City Ordinance Code, Chapter 13, Section 1:292 and Chapter 29, Section 2:72. (Excerpts from the Public Act and the City Ordinance Code are attached. Attachment 1)

This year’s total for potential placement on the next tax roll is $69,341.96. A listing of the delinquent accounts is available for inspection in the Clerk’s office and the Customer Service Center, 220 E. Huron St, Suite 100.

However, notice will be sent to owners by first class mail on May 5, 2009. This notice states that the total amount due, if unpaid as of June 4, 2009, will be placed on the July 2009 tax roll with a 10% penalty. This notice usually results in about 50% of the delinquent bills being paid. All delinquent bills after that time will appear on the July tax statements. A blank sample of the notice letter is attached (Attachment 2).
