Resolution to Direct the City Administrator and City Attorney to Prepare an Ordinance Amendment that Limits the Number of Medical Marijuana Facilities within the City and to Impose a Temporary Moratorium On the Issuance of Provisioning Center Permits With Exceptions

Whereas, On, November 9, 2017 City Council approved Ordinance No. ORD-17-19 which authorized marijuana facilities to operate within the City of Ann Arbor and established a permit process consistent with the current provisions of state law;
Whereas, On December 18, 2017 City Council approved Ordinance No. ORD-17-21 which provided zoning requirements for medical marijuana facilities within the City consistent with the current provisions of state law;
Whereas, The City has received over thirty petitions for special exception use for medical marijuana provisioning centers since the effective date of the zoning ordinance, February 12, 2018, and the City Council is concerned about the concentration of medical marijuana provisioning centers, within the City;
Whereas, State law allows the City to adopt an ordinance that authorizes the types of medical marijuana facilities in the City, as well as providing a limit of the number of each type;
Whereas, City Council would like to consider limiting the number of medical marijuana provisioning centers and other medical marijuana facilities in order to determine the effect over time of having medical marijuana facilities in the community, given the significant amount of interest in opening these facilities within the City; and
Whereas, City Council has concluded that during the consideration of this ordinance amendment, it would be counter-productive to continue to approve new applications for City permits for marijuana provisioning centers;
RESOLVED, That City Council direct that the City Administrator and City Attorney draft an amendment to Ann Arbor City Code, Chapter 96, that limits the number of medical marijuana provisioning center permits available to the number of approvable In Queue Petitions (as defined below) , and that the amendment be presented to City Council for consideration by May 7, 2018;
RESOLVED, That City Council hereby imposes a moratorium on the issuance of permits for medical marijuana provisioning centers for a period of 60 days from the date of this resolution in conjunction with the consideration of the proposed ordinance amendment, with the exception of provisioning centers whose complete petitions for special exception use have been accepted for consideration by the City by the date of this resolution (“In Queue Petitions”);
RESOLVED, That City Council finds it necessary to impose this moratorium in order to promote the public health, safety, and welfare of City residents; and
RESOLVED, That prior to the expiration of this moratorium, City Council may extend the moratorium for an additional 60 days to allow sufficient time to consider appropriate regulations.
