Resolution to Award a Construction Contract to Bailey Excavating, Inc. for the Crest, Buena Vista, Washington Water Main Replacement Project ($1,749,825.00)

Attached for your review and approval is a resolution to award a construction contract to Bailey Excavating, Inc. in the amount of $1,749,825.00 for the Crest, Buena Vista, Washington Water Main Replacement Project.
The Crest, Buena Vista, Washington Water Main Replacement Project will consist of the replacement of 4 inch and 6 inch water mains along Crest Avenue between Buena Vista Avenue and Huron Street, along Buena Vista Avenue between Crest Avenue and Washington Street, and along Washington Street between Crest Avenue and Seventh Street with 8 inch and 12 inch water main. The project also includes bump-outs along Washington, new sidewalk ramps, some curb and gutter replacement, drainage structure replacements, and street resurfacing.
Project plans and specifications were distributed electronically to contractors, subcontractors, and suppliers through the City of Ann Arbor’s procurement website and MITN.info. Three bids were received and opened on March 2, 2018. The lowest responsible bid, from Bailey Excavating, Inc., in the amount of $1,749,825.00 was 7.8% below the Engineer’s Estimate. Attached is a summary of the bids received for the project.
Bailey Excavating, Inc. has successfully completed similar work in the City of Ann Arbor in the past, and is able to meet the project requirements.
Bailey Excavating, Inc. has submitted all required Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances.
Budget/Fiscal Impact
The current Capital Improvements Plan (CIP) includes the Crest, Buena Vista, Washington Water Main Replacement Project (UT-WS-12-06). Funding for the project is included in the approved capital budgets for the Water Supply System and the Street, Bridge and Sidewalk Millage.

Whereas, The existing water mains along Crest Avenue, Buena Vista Avenue, and W. Washington Street within the project limits are in poor condition and undersized, and are in need of replacement;
Whereas, Crest, Buena Vista, Washington Water Main Replacement Project also includes the replacement of the asphalt pavement, installation of new bump-outs on Washington Street, and the placement of new sidewalk curb ramps;
Whereas, The Capital Improvements Plan (CIP) includes sufficient funds for the Crest, Buena Vista, Washington Water Main Replacement Project (UT-WS-12-06);
Whereas, Funding for this project is included in the Water Supply System and the Street, Bridge and Sidewalk Millage approved capital budgets;
Whereas, Competitive bids were received by Procurement on March 2, 2018 (ITB-4525) and Bailey Excavating, Inc. was the low responsible bidder with a submitted bid of $1,749,825.00;
Whereas, The contractual proposal sets forth the services to be performed by said company, and the payments to be made by the City there for, all of which are agreeable to the City;
Whereas, It is now necessary to enter into a Contract with said company for this construction project; and
Whereas, Bailey Excavating, Inc. has submitted all required Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances;
RESOLVED, That a contract in the amount of $1,749,825.00 be awarded to Bailey Excavating, Inc. for the construction of the Crest, Buena Vista, Washington Water Main Replacement Project;
RESOLVED, That a contingency amount of $175,000.00 be established within the project budget and that the City Administrator be authorized to approve change orders to the construction contract with Bailey Excavating, Inc., not to exceed that amount, in order to satisfactorily complete this project;
RESOLVED, That the City make the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney and approval as to substance by the Public Services Area Administrator and City Administrator; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution including approval of needed Traffic Control Orders, night work authorizations, and other similar administrative approvals to allow the work of the project to proceed without delay.
