Resolution Opposing the Concealed Carry Reciprocity Act of 2017 and the Constitutional Concealed Carry Reciprocity Act of 2017

Memorandum

Background

H.R. 38, the Concealed Carry Reciprocity Act of 2017 (1), and S. 446, the Constitutional Concealed Carry Reciprocity Act of 2017 (2), would overrule state laws, by forcing each state to honor concealed carry permits from every other state, no matter the difference in strength of those state laws.  State protections against the proliferation of guns in public will be undermined, and in doing so, endanger law enforcement officers and vastly complicate their jobs. These bills will weaken attempts to stop illegal gun trafficking. Local resistance to these federal measures has been increasing. The US Conference of Mayors has passed a resolution in opposition (3), as well as the American Bar Association (4). It is deplorable that we cannot work together as a country to pass sensible gun legislation at the national level, so we must act locally to combat this public health issue.

 

Police, District Attorneys of major cities, state Attorneys General, military leaders, and professional organizations have spoken out against CCR (6). The California State Legislature has put its opposition on the record (7), and other states are moving such measures forward.  In addition, 28 city/town councils have adopted resolutions opposing HR38/S446: New York, NY (8), Los Angeles, CA (9), Chicago, IL (10), San Francisco, CA (11), Oakland, CA (12), Minneapolis, MN (13), New Orleans, LA (14), St. Paul, MN (15), Newark, NJ (16), Rochester, NY (17), Providence, RI (18), Syracuse, NY (19), Elizabeth, NJ (20), Hartford, CT (21), Berkeley, CA (22), Cambridge, MA (23), Somerville, MA (24), Wilmington, DE (25), East Orange, NJ (26), Hoboken, NJ (27), Teaneck, NJ (28), Fort Lee, NJ (29), Ithaca, NY (30), Tenafly, NJ (31), Westwood, NJ (32), Cresskill, NJ (33), Byram, NJ (34), Old Tappan, NJ (35), and Woodcliff Lake, NJ (36). Still others have resolutions in the works.

Whereas, On January 3, 2017, U.S. Representative Richard Hudson (R-NC) introduced HR 38 and on February 27, 2017, U.S. Senator John Cornyn (R-TX) introduced S 446, both known as the Concealed Carry Reciprocity Act of 2017;

 

Whereas, The U.S House of Representatives passed HR38, Concealed Carry Reciprocity Act of 2017 on December 6, 2017 by a vote of 231-198;

 

Whereas, The U.S. Senate Judiciary Committee held hearings on S446 on March 14, 2018, but has not yet moved the bill to the Senate floor;

 

Whereas, While every state allows concealed carry of firearms under some circumstances, each state has different requirements on who is permitted to carry, what requirements are appropriate, and what type of training should be required of permit holders;

 

Whereas, The Concealed Carry Reciprocity Act of 2017 would allow people with concealed carry permits in one state to take their weapon to any other state, even if the other state has stricter limits on concealed carry weapons than the home state in which they obtained their permit;

 

Whereas, These Concealed Carry Reciprocity bills would override existing state laws and local practice and severely limit Michigan’s ability to prevent criminal firearm trafficking, criminal possession of weapons, and the general proliferation of firearms in public places; and

 

Whereas, The Ann Arbor City Council has established policy positions regarding firearms and firearm regulations, most recently preparing an amicus brief supporting the Ann Arbor Public Schools prohibition of firearms on school property;

 

RESOLVED, That the City of Ann Arbor opposes H.R.38 and S.446, the Concealed Carry Reciprocity Act of 2017, and calls on its representatives in the U.S. House of Representatives and Senate to vote against these bills, and to work with their colleagues to oppose these bills.
