Resolution to Accept a Water Main Easement at 505 Riverview Drive from Daniel Leung and Joy Tien Leung as Trustees of the Daniel Leung and Joy Tien Leung Living Trust dated March 3, 2016 (8 Votes Required)

Memorandum

This easement allows the City to close a water main loop in the Geddes/Riverview area as recommended in the CIP as part of the Riverview Drive Water Main and Sanitary Sewer Extension Project. Closing this loop requires an easement over private property. In exchange for granting the easement, the grantor will not be charged an extension or capital cost recovery charge, or tap, meter set, or plumbing permit fee, and the City will install a water service from the main to allow for connection to grantor’s property.

 

Acceptance of this easement is recommended.

Whereas, Daniel Leung and Joy Tien Leung as Trustees of the Daniel Leung and Joy Tien Leung Living Trust dated March 3, 2016 are the owners of property commonly known as 505 Riverview Drive, described in Liber 5140, Page 607 of Deeds, Washtenaw County Records; and

 

Whereas, Daniel Leung and Joy Tien Leung as Trustees of the Daniel Leung and Joy Tien Leung Living Trust dated March 3, 2016 have signed a grant of easement for water mains and appurtenances, described as:

 

A VARIABLE WIDTH EASEMENT FOR WATER MAIN BEING PART OF THE SOUTHEAST 1/4 QUARTER OF SECTION 27, T.2S., R.6E., CITY OF ANN ARBOR, WASHTENAW COUNTY, MICHIGAN, MORE PARTICULARLY DESCRIBED AS:

BEGINNING AT THE SOUTHEAST CORNER OF LOT 19 OF “GEDDES AVENUE RIVER VIEW HEIGHTS”, CITY OF ANN ARBOR, WASHTENAW COUNTY, MICHIGAN, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN LIBER 6, PAGE(S) 37, WASHTENAW COUNTY RECORDS; THENCE NORTH 67 DEGREES 56 MINUTES 00 SECONDS WEST, 21.21 FEET; THENCE SOUTH 67 DEGREES 04 MINUTES 00 SECONDS WEST, 113.26 FEET TO A POINT ON THE SOUTHWESTERLY LINE OF SAID LOT 19, SAID LINE ALSO BEING THE EASTERLY RIGHT-OF-WAY LINE OF RIVERVIEW DRIVE (VARIABLE WIDTH); THENCE 21.22 FEET ALONG THE ARC OF A CURVE TO THE LEFT HAVING A RADIUS OF 72.71 FEET, A CENTRAL ANGLE OF 16 DEGREES 43 MINUTES 04 SECONDS, WHOSE CHORD BEARS  NORTH 41 DEGREES 46 MINUTES 00 SECONDS WEST, 21.14 FEET; THENCE NORTH 67 DEGREES 04 MINUTES 00 SECONDS EAST, 163.73 FEET; THENCE SOUTH 23 DEGREES 11 MINUTES 47 SECONDS EAST, 30.94 FEET; THENCE ALONG THE NORTHERLY LINE OF PARCEL 09-09-27-401-028 (#640 GEDDES RIDGE AVENUE) SOUTH 59 DEGREES 02 MINUTES 00 SECONDS WEST, 29.08 FEET TO THE POINT OF BEGINNING. RESOLVED, That the City of Ann Arbor hereby accepts this grant of easement.
