Resolution to Terminate Development Agreement with Grace Bible Church, 1300 South Maple

Memorandum

On September 8, 2008, the City executed a development agreement with Grace Bible Church, located at 1300 South Maple Road. This development agreement was executed and recorded in support of an adjacent development, 42 North.

 

This development did not move forward, and accordingly, the provisions of the development agreement with Grace Bible Church are no longer applicable. 

 

Approval of the attached resolution will direct the Mayor and Clerk to execute the attached Termination of Development Agreement Grace Bible Church.

Whereas, On September 8, 2008, the City executed a Development Agreement with Grace Bible Church, identifying responsibilities associated with the adjacent 42 North proposed development; and

 

Whereas, the 42 North Development did not proceed, has expired, and the corresponding obligations of the Grace Bible Church Development Agreement are no longer required;

 

RESOLVED, That City Council approve the Termination of Development Agreement Grace Bible Church, substantially in the form of that attached;

 

RESOLVED, That the Mayor and City Clerk are authorized and directed to sign the Amendment after approval as to substance by the City Administrator and approval as to form by the City Attorney; and

 

RESOLVED, That the City Administrator is authorized to take all necessary administrative actions to complete the proposed termination.
