Resolution to Extend the Temporary Moratorium on Ground Mounted Solar Panels and Arrays in the Front Open Space in Residential and Parking Zoning Districts

Body

Whereas, On April 17, 2017, City Council approved Resolution R-17-120 that imposed a 180-day moratorium deferring consideration of all requests for permits to erect new ground mounted solar panels or arrays in the front open space of all R-1, R-2, R-3, R-4, R-5, R-6, and P zoning districts;

 

Whereas, The City Planning Commission has drafted proposed ordinance amendments to address ground mounted solar panel arrays which will be presented to City Council on October 16, 2017;

 

Whereas, The original moratorium adopted in R-17-120 expires on October 14, 2017, but it provided that the moratorium may be extended for up to 180 additional days; and

 

Whereas, Extension of the moratorium will provide time for City Council’s consideration of proposed ordinance amendments;

 

RESOLVED, That City Council finds it necessary to extend this temporary moratorium in order to promote the public health, safety, and welfare of City residents, while the Planning Commission develops regulatory language pertaining to ground mounted solar arrays in the front open space; and

 

RESOLVED, That City Council hereby extends the moratorium deferring consideration of all requests for permits to erect new ground mounted solar panels or arrays in the front open space of all R-1, R-2, R-3, R-4, R-5, R-6, and P zoning districts for a period of 180 days from the date of this resolution, or until such time that proposed regulations are adopted and effective, whichever occurs first.
