Resolution to Accept a Water Main Easement at 1608 South University Avenue (Angell Elementary) from the Ann Arbor Public Schools (8 Votes Required)

Memorandum

This easement is in conjunction with a water main easement granted by New Life Church of Ann Arbor to the City of Ann Arbor that was accepted by Council on June 6, 2016 and recorded in Liber 5153, page 888.

 

This easement is in standard form and is conveyed without cost to the City. 

 

Acceptance of this easement is recommended.

Whereas, the Public Schools of the City of Ann Arbor (AAPS) is the owner of property located at 1608 S. University Avenue, commonly known as Angell Elementary; and

 

Whereas, AAPS has signed a grant of easement for water mains and appurtenances, described as:

 

That portion of the following described property that lies within Lot 21, Assessor’s Plat No. 18, in the City of Ann Arbor, Washtenaw County, Michigan, according to the Plat thereof as recorded in Liber 9 of Plats, Page 2, Washtenaw County Records: Beginning at the SW Corner of Lot 21 “Assessor’s Plat No. 18, a part of Sections 28 and 33, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan as recorded in Liber 9 of Plats, Page 2, Washtenaw County Records; thence N47º 08’ 30” E 362.98 feet along the line common to Lots 19 and 21 of said “Assessor’s Plat No. 18” to the SE Corner of Lot 19; thence N00º 32’05” W 42.61 feet; thence N89º 27’ 55” E 40.00 feet; thence S00º 32’ 05” E 33.24 feet; thence S47º 08’ 30” W 17.82 feet; thence S42º 51’ 30” E 10.00 feet; thence S47º 08’ 30” W 40.00 feet; thence N42º 51’ 30” W 10.00 feet; thence  S47º 08’ 30” W 109.49 feet; thence N42º 51’ 30” W 2.49 feet; thence  S47º 08’ 30” W 9.65 feet; thence S42º 51’ 30” E 2.49 feet; thence S47º 08’ 30” W 11.99 feet; thence  S15º 16’ 14” E 24.97 feet; thence S42º 51’ 30” E 17.86 feet; thence S47º 08’ 30” W 40.00 feet; thence N42º 51’ 30” W 20.00 feet; thence S47º 08’ 30” W 158.58 feet to a point on the Northeasterly right-of-way line of Washtenaw Avenue; thence N42º 32’ 00” W 40.00 feet along said right-of-way to  the Point of Beginning.  Being a part of Lots 18 and 21 of said “Assessor’s Plat No. 18” and containing 14,411 square feet or land, more or less.

 

RESOLVED, That the City of Ann Arbor hereby accepts this grant of easement.
