Attached for your review and action is a resolution to approve the Memorandum of Intent (MOI) between the City and the Ann Arbor Skatepark Action Committee and the Ann Arbor Skatepark Fund Agreement between the City, the Ann Arbor Skatepark Action Committee, and the Ann Arbor Area Community Foundation for the development, construction, operation, and maintenance of a skatepark facility at Veterans Memorial Park.
 
There is significant community interest and support to develop a skatepark in a City park. The Ann Arbor Skatepark Action Committee has been working with City staff and the Parks Advisory Commission to address issues and create a plan for the development of a skatepark in a City park.  As a result of those efforts, the Parks Advisory Commission passed a resolution on May 20, 2008 recommending that City Council approve a proposed location of Veterans Memorial Park.  The proposed MOI and Fund Agreement are a result of collaborative work between City staff, Skatepark Action Committee members and Ann Arbor Area Community Foundation staff.
 
The proposed MOI and Fund Agreement stipulate that the Ann Arbor Skatepark Action Committee shall raise funds for the design, construction, operation and maintenance of the Skatepark and will work together with the City regarding the design, construction, operation and maintenance of the skatepark.  Funds will be collected and held by the Ann Arbor Area Community Foundation and will be distributed to the Ann Arbor Skatepark Action Committee and City as the project elements are underway.  10% of all funds raised will be put in an endowed fund for operations, maintenance, and future improvements to the skatepark.
 
The Memorandum of Intent demonstrates how the City and Ann Arbor Skatepark Action Committee will work together toward completion of the Skatepark, and provides a preliminary outline in regard to set dates for the design and construction of the skatepark.  The Ann Arbor Skatepark Fund Agreement allows for fundraising to begin for this project.

Whereas, The Ann Arbor Skatepark Action Committee has been working with City staff and the Parks Advisory Commission to address issues and create a plan for the development of a skatepark in a City park;
 
Whereas, The Parks Advisory Commission passed a resolution on May 20, 2008 supporting the development of a skatepark at Veterans Memorial Park, contingent on the Skatepark meeting or exceeding storm water management standards;
 
Whereas, the City Parks and Recreation Services Unit has designated a parcel of land within Veterans Memorial Park for construction of a City of Ann Arbor skatepark located in the general area as shown on the attached diagram, as long as construction has commenced by January 1, 2014;
 
Whereas, The Ann Arbor Skatepark Action Committee shall raise funds for the design, construction, operation and maintenance of the Skatepark, and the City and Ann Arbor Skatepark Action Committee will work together regarding the design, operation and maintenance of the Skatepark;
 
Whereas, 10% of all funds raised by the Ann Arbor Skatepark Action Committee shall be allocated to an endowed fund through the Ann Arbor Area Community Foundation for operations, maintenance and future improvements of the Skatepark;
 
Whereas, The City of Ann Arbor and the Ann Arbor Skatepark Action Committee wish to state their intent regarding how the parties will work together toward completion of the skatepark, and to specify a preliminary outline of any and all future agreements between the parties regarding the skatepark;
 
Whereas, The City and Ann Arbor Skatepark Action Committee want to establish the Ann Arbor Skatepark Fund to allow for fundraising to begin and the project to move forward; and
 
Whereas, The Parks Advisory Commission recommended approval of Memorandum of Intent and the Fund Agreement at their November 18, 2008 regular meeting;
 
RESOLVED, That the Mayor and City Council agree to the development, construction, and operation of the skatepark facility at Veterans Memorial Park, contingent on: (1) City's receipt of funds raised by Ann Arbor Skatepark Action Committee, the Ann Arbor Area Community Foundation or others providing 100% of the costs of design, development and construction of the Facility; (2) City's receipt of funds for maintenance and operating costs, or approval of a funding mechanism for the provision of these funds; (3) City's approval of the Facility design; and, (4) the terms of the Memorandum of Intent between the City and the Ann Arbor Skatepark Action Committee are satisfied;
 
RESOLVED, That the Mayor and City Council approve the Memorandum of Intent between the City and the Ann Arbor Skatepark Action Committee and the Ann Arbor Skatepark Fund Agreement between the City, the Ann Arbor Skatepark Action Committee, and the Ann Arbor Area Community Foundation for the development, construction, operation, and maintenance of a skatepark facility at Veterans Memorial Park; and
 
RESOLVED, That the City Administrator be authorized to take all necessary administrative actions to implement this resolution.
