Memorandum
Attached for your review and action is a resolution to approve a contract with Margolis Companies in the amount of $28,750.00 to renovate the play area at Riverside Park per Bid #3967, and to establish a total construction project budget of $31,625.00.
 
The 2006-2011 Parks and Recreation Open Space Plan identified replacement of aging playgrounds as a high priority.  The condition of the play area at Riverside Park merits attention because the structures and surfacing have deteriorated and do not meet current safety guidelines.  Funding for the project is included in the approved FY 09 Park Maintenance and Capital Improvements Millage budget, Fund 071.
 
Bid documents were advertised on MITN.  Five companies submitted bids for the project as follows:
 
Margolis Companies - $28,750.00*
Saf' Play Services, Inc. - $29,733.00
TDS Contractors, Inc. - $30,159.00
Cameron Contracting, Inc. - $32,441.64
Outdoor Fun Store, Co. - $63,032.00
 
*Lowest responsible bid
 
The resolution includes a recommended construction contingency of $2,875.00 (10%) to cover potential contract change orders to be approved by the City Administrator.  It is requested that a $31,625.00 total construction project budget be established for the life of the project without regard to fiscal year.
 
Margolis Companies meets the living wage and prevailing wage requirements and received Human Rights approval on May 15, 2008.

Body
Whereas, Infrastructure improvements, including renovations of play areas, are identified in the 2006-2011 Parks and Recreation Open Space Plan;
 
Whereas, The areas identified for funding in FY 09 include the Riverside Park play area;
 
Whereas, The City issued Bid #3967 for park infrastructure improvements and Margolis Companies was selected as the lowest qualified bidder to perform the renovation of the Riverside Park play area; and
 
Whereas, Margolis Companies received Human Rights approval on May 15, 2008 and complies with the living wage and prevailing wage requirements;
 
RESOLVED, That City Council approve a construction contract, per Bid #3967, with Margolis Companies for $28,750.00 and approve a construction contingency of $2,875.00 (10%) to cover potential contract change orders for a total project budget of $31,625.00 to renovate the play area at Riverside Park for the life of the project to be expended without regard to fiscal year;
 
RESOLVED, That the City Administrator be authorized to take all necessary administrative actions to implement this resolution including the authority to approve change orders within the approved contingency; and
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney.
