Attached for your approval is a resolution amending the water improvement charge amount authorized in the resolution for this property approved on March 15, 1999 (R-130-3-99).

This property (Lot 21 Orchard Hills No. 1) along with two adjacent, vacant parcels (Lots 20 and 22 Orchard Hills No. 1) annexed to the City of Ann Arbor on August 19, 1997, per the State of Michigan. The property at 227 Orchard Hills is actively connected to and receiving water utility service.

The water main for Lot 20 was constructed by the City in 1989. Lot 20 is District No. 88036, and the water main improvement charge for this lot remains unchanged as established in the amount of $11,268.01. The water main for Lots 21 and 22 was constructed by the City in 1991. Lots 21 and 22 are included in District No. 89044. The District No. 89044 preliminary water main improvement charge estimate was $9,475.77 for each of the Lots 21 and 22. On August 19, 1996, a resolution ordering a credit on the assessment for District No. 89044 was approved by Council. The result was the preliminary estimate of $9,475.77 was lowered to a final cost of $8,578.22. We are requesting that the water improvement charge be changed for lots 21 and 22 to reflect the credited amount.

The property does not currently have sanitary sewer available to serve the property.

So as not to change either the original resolution number assigned or the date of approval, the approval of this resolution will amend only the portion of resolution R-130-3-99 that specifies the amount of the water improvement charge. Your approval of this resolution will allow us to reapply the previous principle and interest payments. Any overpayment will be refunded.
