Memorandum

Attached for your review and approval is a resolution to establish the special assessment costs and distribution for the curb & gutter proposed as part of the Geddes Avenue Improvements Project (Resolution No. 2 for Curb & Gutter District #505). 

 

During design of the Geddes Avenue Improvements project it was determined that curb and gutter is necessary along the approximate eastern half of the project due to steep grades and the desire to narrow the extent of impacts.  With curb, the extent of grading associated with the roadway and sidewalk can be reduced thus minimizing impacts to the adjacent slopes and trees/vegetation. The curb also provides a means to convey stormwater and structurally protect the pavement edge. 

 

As called for in Chapter 13 of City Code, the cost for the addition of new curb & gutter where none currently exists is borne by the parcels that benefit from the improvements.

 

Resident Input

Property owners affected by the curb & gutter assessments were invited to an Administrative Hearing on May 14, 2015 where staff explained the methodology and the estimated assessment amounts.  Five residents attended the meeting.  Their concerns related to the method of assigning cost among properties where one property fronts the road but the others share access off of Geddes Ave.  The Assessor revisited some these costs. 

 

The unit price of $20/ft that was shared with the residents has since been reduced to $13/ft based on the low bidder’s unit price for curb & gutter. 

The total estimated cost of the new proposed curb & gutter along Geddes is approximately $69,329.00.  Of this amount, $15,428.00 is proposed to be funded by special assessment of city parcels, $4,082.00 for Devonshire Park to be funded by the Park Maintenance and Capital Improvements Millage, and $4,742.00 is anticipated future recoverable following annexation of the affected Township parcels.

Whereas, Plans and specifications have been prepared for the Geddes Avenue Improvements Project, Curb & Gutter District #505;

 

Whereas, In accordance with Chapter 13 of City Code, the cost for the addition of new curb & gutter is borne by the benefitting parcels; and

 

Whereas, A construction estimate and appropriate funding sources have been established; and

 

RESOLVED, That the City Council determines the total cost of said Geddes Avenue curb & gutter including all incidentals, to be approximately $69,329.00 local share;

 

RESOLVED, That of the local share $15,428.00 be paid by special assessment upon the properties specially benefited;

 

RESOLVED, That $4,082.00 by paid by the Park Maintenance and Capital Improvements Millage for the benefitting Devonshire Park;

 

RESOLVED, That the following described lots and parcels of land be designated as constituting the special assessment district against which the cost of said improvements shall be assessed, or against which an improvement charge shall, pursuant to Section 1.278 of the City Code, be levied:

RESOLVED, That the City Assessor be hereby directed to prepare a special assessment roll in accordance with the foregoing determinations of the City Council and to file the same, together with his certificate attached thereto, with the City Clerk for presentation to the City Council.
