Resolution to Withdraw Petitions to the State of Michigan Boundary Commission to Annex Various Parcels from the Charter Township of Ann Arbor
Memorandum
Attached is a resolution authorizing withdrawal of petitions that have been submitted to the State of Michigan Boundary Commission for annexation of various parcels from the Charter Township of Ann Arbor.
On October 20, 2014, City Council authorized petitions to the State of Michigan Boundary Commission to annex various parcels identified as township islands within City's ultimate utility service area (Resolution R-14-363). Subsequently, the petitions for annexation of the identified township islands were submitted to the State, and reviewed for legal sufficiency by Boundary Commission staff.
Boundary Commission staff have identified technical errors related to the legal descriptions and land survey maps included as part of the submitted petitions. The process for Annexation by Council Resolution per the State of Michigan Boundary Commission General Rules does not allow petitions to be modified after submittal. Due to the identified errors and need to modify some elements of the petitions, formal withdrawal of petitions by Council resolution is required.
Updated petitions, including corrected legal descriptions and land survey maps, have been prepared. City Council will be asked to approve resolutions authorizing submittal of the updated petitions following Council action to withdrawal the existing petitions.
