Attached for your review and approval is a resolution to award a contract to E. T. MacKenzie Company in the amount of $672,500.00 for the Lawrence Street Water Main Replacement and Summit Street Water Main Replacement Project.
Budget/Fiscal Impact
The current City of Ann Arbor Capital Improvements Plan (CIP) includes projects UT-WS-14-11 and UT-WS-16-07, the Lawrence Street Water Main Upsizing and Summit Street (Wheeler Park) Transmission Water Main Replacement projects. The total cost of the project is estimated at $ 900,000.00. This project is being funded by the approved Water Fund Capital budget ($779,740.00), Street Resurfacing Millage Capital budget ($ 31,000.00), Storm Water Capital Budget ($ 32,000.00) and Park Maintenance and Capital Improvement Millage ($ 57,260.00).
The existing water main along Lawrence Street has experienced frequent breaks, is undersized, and is in poor condition. The existing transmission water main along Summit Street through Wheeler Park is also in poor condition and needs to be replaced. This project will replace the existing water main along Lawrence Street between Division Street and State Street with 750 feet of new 12-inch water main and replace the existing water main along Summit Street through Wheeler Park between Fourth Avenue and Fifth Avenue with 470 feet of new 16-inch water main. Also included in this project, is the replacement of some curb and gutter, and reconstruction of some storm sewer structures, replacement of portions of the track and basketball court within Wheeler Park, and all related work. The final resurfacing of Lawrence Street will be performed under a separate contract by the 2015 Street Resurfacing Project.
In response to the invitation to bid (ITB-4367), four (4) bids were received on Thursday, March 5, 2015. The low bid from E. T. MacKenzie Company of $672,500.00 is approximately 5% lower than the Engineer's Estimate.
The construction of the project is scheduled to begin in May of 2015 and to be completed in August 2015.
The contractor complies with the requirements of the City's non-discrimination and living wage ordinances.

Whereas, The existing water mains along Lawrence Street between Division Street and State Street; and along Summit Street through Wheeler Park between Fourth Avenue and Fifth Avenue are in poor condition, and must be replaced;
Whereas, The projects are included in the City's Capital Improvement Plan;
Whereas, Funding for this project is included is included in the approved capital budget;
Whereas, Competitive bids were received by the Procurement Unit on March 5, 2015 and E. T. MacKenzie Company of Grand Ledge, MI, was the lowest responsible bidder at $672,500;
Whereas, It is now necessary to enter into a contract with E. T. MacKenzie Company for the construction of Lawrence Street Water Main Replacement and Summit Street Water Main Replacement Project; and
Whereas, E. T. MacKenzie Company complies with the requirements of the City's non-discrimination and living wage ordinances;
RESOLVED, That a contract in the amount of $672,500.00 be awarded to E. T. MacKenzie Company for the construction of the Lawrence Street Water Main Replacement and Summit Street Water Main Replacement Project (Bid No. ITB-4367);
RESOLVED, That a contract contingency amount of $80,000.00 be established and that the City Administrator be authorized to approve additional change orders to the construction contract with E. T. MacKenzie Company not to exceed $80,000.00 in order to satisfactorily complete this project;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney, and approval as to substance by the City Administrator;
RESOLVED, That the City makes the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and
RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this project, including issuing Traffic Control Orders for the streets included in this project, including parking prohibition as needed in excess of 1 block and/or 90 days.
