Resolution to Approve Amendment No. 1 to the Services Agreement with Solomon Diving, Inc. for Dive Inspection Services ($75,000.00)
Memorandum
This memorandum and resolution requests approval of Amendment No. 1 to the services agreement for dive inspection services with Solomon Diving, Inc. (Solomon) for an additional $75,000.00 to be expended in FY15 and FY16. A services agreement was executed in November 2013 with Solomon for up to $20,000.00 per each year for FY14, FY15 and FY16.
The City is seeking to amend the services agreement with Solomon to accommodate additional dive inspection service needs through the next two fiscal years. The original scope of work included the annual inspection and cleaning of the drinking water intakes in Barton Pond, the hydroelectric generating station intakes at Barton and Superior Dams, and general underwater inspection and cleaning services at all four City-owned dams.
In the Fall of 2014, a suspected leak in the raw water piping associated with Barton Pumping Station was detected. The City has used the diving services contract in an effort to determine the location of the leak and will need additional diving services as part of future remedial action. The City has exhausted the FY15 diving services contractual limit for FY15 and requests the additional funds to cover the services anticipated over the remainder of this fiscal year and next fiscal year associated with addressing leaking pipe at Barton Pumping Station.
It is therefore, recommended that City Council approve Amendment No. 1 to the services agreement with Solomon, to provide additional Dive Inspection Services for FY15 and FY16.
Solomon complies with the requirements of the Nondiscrimination and Living Wage Ordinances.
These services are to be funded from the approved FY15 Water Supply System, Parks, and Hydro Fund operating budgets, for which services are rendered, but with those funds to be made available without regard to fiscal year for work done in FY16.

Whereas, The Water Treatment Services Unit (WTSU) is seeking to amend the Dive Inspection Services Agreement with Solomon for additional services to investigate and repair a leak that was detected at Barton Pumping Station;
Whereas, The WTSU has exhausted the existing contract amount of $20,000.00 for FY15 with Solomon Diving;
Whereas, The additional Dive Inspection Services will be funded from the approved FY15 Water Supply System, Parks, and Hydro Fund Operating budgets; and
Whereas, Solomon complies with the requirements of the Nondiscrimination and Living Wage Ordinances;
RESOLVED, That the Amendment No. 1 to the Services Agreement with Solomon is approved in the amount of $75,000.00;
RESOLVED, That the Mayor and City Clerk are authorized and directed to execute Amendment No.1 to the Services Agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney;
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution;
RESOLVED, That the additional dive inspection services be funded from the approved FY15 Water Supply System, Parks, and Hydro Fund Operating budgets; and
RESOLVED, That the funds be made available for the life of the project(s) without regard to fiscal year until the Service Agreement's end on June 30, 2016.
