Memorandum
Attached for your review and approval is a resolution to extend the Construction Contract with Doan Construction Company (Bid No. 4320) for the 2015 Ramp & Sidewalk Repair Project.
 
Budget Impact
The project is an anticipated annual expenditure and will be funded from the approved Street Resurfacing and Sidewalk Repair Millage capital budget for an amount of $1,900,000.00.   
 
The 2015 Sidewalk Cutting Project will consist of the repair of deficient sidewalks in approximately 20% of the City in 2015, as part of the fourth year of a 5-year program to perform repairs on the City's entire sidewalk system. The attached map shows the areas of the City and their schedule for repairs in each year.
 
In addition to sidewalk repairs, the project also includes the continued replacement of sidewalk curb ramps to meet the requirements of the Americans with Disabilities Act (ADA) as required by our Consent Decree.
 
Doan Construction Company was the low bidder for the 2014 Ramp & Sidewalk Repair Project, which provides for a one-year extension to the 2015 construction season, by mutual agreement of the City and the Contractor. Doan Construction Company was also the low bidder and contractor for the 2012 and 2013 Ramp & Sidewalk Repair Projects. Based on Doan Construction Company's performance over the last three years, City staff recommends that their contract be extended for one year as allowed for in the 2014 contract.
 
The Ramp & Sidewalk Repair Project is created as a unit price contract with the understanding that the actual quantities used in construction will vary.
Doan Construction Company complies with the requirements of the nondiscrimination and living wage ordinances.

Whereas, The City of Ann Arbor approved capital budget includes sufficient funds for the annual Ramp & Sidewalk Repair Project;
 
Whereas, The 2015 Ramp & Sidewalk Repair Project includes the repair of deficient sidewalks in approximately 20% of the City and the continued replacement of sidewalk curb ramps to meet the requirements of the Americans with Disabilities Act (ADA) and the approved Consent Decree;
 
Whereas, The 2015 Ramp & Sidewalk Repair Project is necessary to maintain high quality pedestrian facilities in the City of Ann Arbor;
 
Whereas, Competitive bids were received by Procurement on March 5, 2014 and Doan Construction Company was the lowest responsible bidder;
 
Whereas, Doan Construction Company performed ramp and sidewalk repairs in 2012, 2013, and 2014 to the satisfaction of the City;
 
Whereas, The current contract sets forth the services to be performed by said Doan Construction Company, and the payments to be made by the City there for, all of which are agreeable to the City;
 
Whereas, The 2014 Contract provides for an extension of the contract for one (1) one-year term, subject to the terms and conditions in the original contract;
 
Whereas, Doan Construction Company complies with the requirements of the Nondiscrimination and Living Wage Ordinances;
 
RESOLVED, That a contract extension in the amount of $1,900,000.00 be awarded to Doan Construction Company for the construction of the 2015 Ramp & Sidewalk Repair Project;
 
RESOLVED, That a contingency amount of $190,000.00 be established within the project budget and that the City Administrator be authorized to approve change orders to the construction contract with Doan Construction Company, not to exceed that amount, in order to satisfactorily complete this project; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
