An Ordinance to Amend Section 1:207, Taxicab Board, of Chapter 8, Organization of Boards and Commissions of Title I of the Code of the City of Ann Arbor (Ordinance No. ORD-14-27)
Memorandum
Your approval is requested to amend Section 1:207, Taxicab Board, of Chapter 8 of Boards and Commission of Title I of the Code of the City of Ann Arbor.  
 
Currently, the Chief Financial Officer is a non-voting member of the Taxicab Board and acts as the administrator and secretary of the Board. The ordinance change will direct responsibility of this position to a City Administrator's designee (anticipated to be the City Clerk).
 
The City Clerk, at present, is responsible for issuing taxicab licenses, taxicab driver's licenses, company licenses, and bond plates.  The resulting language would allow all taxicab board activities to be supported by the same staff.  The ordinance change is consistent with other City Clerk's in many Michigan municipalities.
 
In addition, the reference to expiration of members terms in subsection 2 has been deleted.  Deletion of the language removes its inconsistency with Section 12.5(a) of the City Charter.
 
Approval of this ordinance amendment is recommended.

ORGANIZATION OF BOARDS AND COMMISSION
TAXICAB BOARD
 
AN ORDINANCE TO AMEND SECTION 1:207 OF CHAPTER 8, ORGANIZATION OF BOARDS AND COMMISSIONS OF TITLE I OF THE CODE OF THE CITY OF ANN ARBOR
 
The City of Ann Arbor Ordains:
 
Section 1:  That Section 1:207, Taxicab Board, of Chapter 8, of Title of the Code of the
City of Ann Arbor be amended to read as follows:
 
1: 207. Taxicab Board.
 
 
(1) The Taxicab Board shall consist of 5 voting members who shall be appointed by the Mayor, subject to the approval of the City Council. One of the voting members shall be a member of the City Council. The other 4 members shall not be officers or employees of the city. The Chief Financial OfficerCity Administrator's  designee  and  Chief  of  Police, or his designee, shall  be  nonvoting  board members.
 
 
(2) The term of the Councilmember shall be 1 year. The term of the other 4 voting members shall be 3 years.  All terms shall expire on the second Monday in April. If a person ceases to be a member prior to the end of the term of appointment,  a  replacement  shall  be  appointed  by  the  mMayor  for  the remainder of the original term.
 
 
(3) The  Chief Financial OfficerCity Administrator's designee shall serve as secretary of the board. The board shall elect its own Chairman  each April who shall serve for a term of 1 year.
 
 
(4) The Taxicab Board shall have the powers and duties described in Chapter
85 of this Code.
 
Section 2: This Ordinance shall take effect on the tenth day following legal publication.
