Memorandum
Attached for your review and action is a resolution to approve a $131,700.00 contract with Sinclair Recreation to make improvements to playgrounds at Arbor Oaks, Scheffler and North Main Parks.
 
A goal of the Parks and Recreation Open Space Plan is to have a neighborhood park within a ¼ mile of each residence. Arbor Oaks and Scheffler parks are both neighborhood parks that are in need of replacement play structures due to the condition of the equipment, and are noted in the CIP.
 
Public meetings were held for the Arbor Oaks and Scheffler Park projects, and the designs were informed by public input gathered at the meetings and through neighborhood surveys sent to all neighbors within ¼ mile of the parks.
 
A tire swing and chess table are being added to North Main Park. The equipment and installation is being funded through a development contribution. The developer held a public meeting with the neighborhood and met with staff to determine appropriate improvements. These items were embraced by neighbors as a positive addition to the park.
 
The projects were bid together because they are similar in scope, all requiring similar construction type and materials as well as playground equipment. This also often results in better pricing, as there is a greater quantity of materials to be ordered.
 
Five bids were received by the City for this project in response to ITB 4330:
 
Game Time c/o Sinclair Recreation      $131,700.00*
Miracle Recreation      $132,000.00
Playworld Midstates      $133,832.56
Superior Play      $166,909.00
Play and Park Structures      $250,422.00
 
*Lowest responsible bidder.
 
Staff is recommending awarding a contract to Game Time c/o Sinclair Recreation in the amount of $131,700.00. A 10% construction contingency ($13,170.00) is requested to cover potential contract change orders to be approved by the City Administrator.  It is requested that a $144,870.00 contract and contingency amount be approved for the life of the project without regard to fiscal year. Funding for Arbor Oaks and Scheffler Parks is available in the approved FY2015 Park Maintenance and Capital Improvement Millage budget.  Funding for improvements to North Main Park is available in the FY2015 Park Memorials and Contributions Fund.
 
The Park Advisory Commission recommended approval of this contract at their April 15, 2014 meeting.
 
Game Time c/o Sinclair Recreation meets the living wage and prevailing wage requirements and received Human Rights approval on April 4, 2014.

Whereas, A developer contribution is funding additional playground equipment at North Main Park,   
 
Whereas, The Parks and Recreation Open Space Plan recommends replacing playgrounds as necessary,
 
Whereas, Funding is available in the approved FY2015 Parks Maintenance and Capital Improvements Millage Fund and the Park Memorials and Contributions Fund;
 
Whereas, The Park Advisory Commission recommended approval of this contract at their April 15, 2014 meeting;
 
Whereas, Competitive bids were received by Purchasing on March 31, 2014;
 
Whereas, Game Time c/o Sinclair Recreation submitted the lowest responsive bid; and
 
Whereas, Game Time c/o Sinclair Recreation received Human Rights approval on April 4, 2014;
 
RESOLVED, That City Council approve a contract with Game Time c/o Sinclair Recreation for playground replacements at Arbor Oaks and Scheffler Parks and improvements to the North Main Park playground in the amount of $131,700.00 and approve a construction contingency of $13,170.00 (10%) to cover potential contract change orders for a total contract amount of $144,870.00 for the life of the project without regard to fiscal year;
 
RESOLVED, That the City Administrator be authorized to take all necessary administrative actions to implement this resolution including the authority to approve change orders within the approved contingency; and
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney.
