Attached for your review and action is a resolution to approve a $134,297.80 contract with Nagle Paving Company to relocate and rebuild the tennis courts at Windemere Park.
 
The Windemere Park tennis courts were constructed in 1986. Three years ago significant cracks appeared and numerous repair attempts were unsuccessful. Upon investigation it was determined that the soils in the area and directly beneath the tennis court are not at all suitable for the placement of a court.   As such, the tennis courts are being relocated to an area of the park where the soils are suitable for such an amenity. Replacing the courts in the same location would have been prohibitively expensive.
 
Three public meetings were held with the neighborhood to decide an alternative location for the tennis courts. The new location, in the northeast central portion of the park was approved by PAC at their January 28th meeting. PAC unanimously recommended approval of this contract at the February 25th meeting.
 
Five bids were received in response to ITB 4321:
 
Nagle Paving      $134,297.80*
Best Asphalt      $159,370.70
Pat USA      $162,614.77
Pavex Corporation      $169,784.38
Fonson, Inc.       $177,769.90      *Lowest responsible bidder.
 
Staff is recommending awarding a contract to Nagle Paving Company in the amount of $134,297.80 for improvements to Windemere Park tennis courts. A 10% construction contingency ($13,430.00) is requested to cover potential contract change orders to be approved by the City Administrator.  It is requested that a $147,727.80 contract and contingency amount be approved for the life of the project without regard to fiscal year. Funding is available in the approved FY2014 Park Maintenance and Capital Improvement Millage budget.
 
Nagle Paving Company meets the living wage and prevailing wage requirements and received Human Rights approval on February 21, 2014.

Whereas, The Windemere Park tennis courts are in major disrepair and need to be relocated and rebuilt;
 
Whereas, The Parks and Recreation Open Space Plan recommends infrastructure improvements to tennis courts in 2014;
 
Whereas, Multiple public meetings were held and public input sought regarding the relocation of the courts;
 
Whereas, The Park Advisory Commission voted unanimously at their January 28, 2014 meeting to relocate the courts to location "1A", roughly in the north central/east portion of the park;
 
Whereas, The Park Advisory Commission voted unanimously at their February 25, 2014 meeting to recommend approval of this contract;
 
Whereas, Funding is available in the approved FY2014 Park Maintenance and Capital Improvement Millage budget;
 
Whereas, Competitive bids were received by Purchasing on February 20, 2014;
 
Whereas, Nagle Paving Company submitted the lowest responsive bid; and
 
Whereas, Nagle Paving Company received Human Rights approval on February 21, 2014;
 
RESOLVED, That City Council approve a contract with Nagle Paving Company for $134,297.80 to relocate and rebuild the tennis courts at Windemere Park and approve a construction contingency of $13,430.00 (10%) to cover potential contract change orders with funds to be available for the expenditure during the life of the project without regard to fiscal year;
 
RESOLVED, That the City Administrator be authorized to take all necessary administrative actions to implement this resolution including the authority to approve change orders within the approved contingency; and
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney.
