Memorandum
There is a resolution before you to accept an easement from 3965 South State Street Associates, L.L.C. for water mains, storm sewers, and sanitary sewers at 3965 South State Street (Tim Horton's).
The easement is in standard form and conveyed without cost to the City.
Acceptance of the easement is recommended.

Whereas, 3965 South State Associates, L.L.C., a Michigan limited liability company, is the owner of property commonly known as 3965 South State Street, Ann Arbor Michigan 48108, described in Liber 4715, Pages 626-628 of Deeds, Washtenaw County Records;
Whereas, 3965 South State Associates, L.L.C. has executed and delivered a grant of easement for water mains, storm sewers, and sanitary sewers, more particularly described as:
Commencing at the Southwest corner of Section 9, T.3S., R.6E., City of Ann Arbor, Washtenaw County, Michigan; thence N87°53'20"E 183.01 feet along the South line of said Section 9 and the centerline of W. Ellsworth Road (43 foot half width); thence N01°06'00"W 99.27 feet for a Place Of Beginning; thence continuing N01°06'00"W 30.00 feet; thence N89°15'36"E 344.94 feet; thence S01°06'00"E 30.00 feet; thence S89°15'36"W 344.94 feet to the Place of Beginning.
RESOLVED, That the City of Ann Arbor hereby accepts this grant of easement.
