Memorandum
This memorandum and resolution requests approval to award a contract to Erie Construction, LLC for construction of the Arbor Oaks Rain Gardens in the amount of $149,925.00.

This project involves regrading a portion of Arbor Oaks Park to accommodate the installation of a series of rain gardens which are designed to detain and infiltrate bank-full rain events. In addition, to ensure positive drainage to the rain gardens from a large open area within the park, and to make this area usable for neighborhood residents, soil will be placed to raise the elevation of the open area. The Michigan Department of Environmental Quality is financing this project through the USEPA Surface Water Revolving Fund and the project is eligible for up to 50% loan principal forgiveness for water quality improvements construction costs.

The City received the following two bids for construction services:

Erie Construction, LLC $149,925.00
Inland Lakes Landscaping Corp. $160,601.98

Erie Construction, LLC submitted the lowest and responsible bid in the amount of $149,925.00. It is recommended that the bid from Erie Construction, LLC for $149,925.00 be accepted, and that Erie Construction, LLC be awarded the contract for the Arbor Oaks Rain Gardens.

The total cost of the project is anticipated to be $164,925.00, which includes a contingency in the amount of $15,000.00 for Erie Construction, LLC for change orders to be approved by the City Administrator.

Erie Construction, LLC received Human Rights and contract compliance approval on May 30, 2013.

Funds for this project are to be advanced from the approved Stormwater Capital budget pending reimbursement from the Surface Water Revolving Fund.
